Hi All,
Once again I am on here seeking the advice on employment issues. The flame seems now to become my own personal forum for asking for advice. I started on an oil platform last year 2nd November 2021 as a Fire and Gas Technician ( my rota is 2 weeks on 3 weeks). Two trips ago I was transfered to Instrument technician department and I have just completed the second trip offshore in this role. Four days before the end of my last trip I was issued with a Performance Improvement Plan. My company has a website based competency plan and my competency profile modules are based on Fire and Gas Technician. The PIP requires me to complete various requirements after 3 trips offshore. However, I am unable to achieve some of the requirements as I do not have access to the permit to work system until I complete electrical and mechanical authorisation. I am expected to complete 20% of the competency by the end of November, but my portfolio is set up for fire and gas, and yet I am working in a different department. I realise that there are many people who are not familiar with the PIP or offshore work, however any advice would be appreciated. But to kick this topic off, am I allowed an Union Representative or another person, when I have a meeting with offshore line manager. Further I have not signed the PIP, however I daresay I will be pressured into signing it regardless of the unfairness of it. -------------------- STAND UP FOR YOURSELF OR YOU WILL FALL FOR ANYTHING

2.2 Paragraph 2 is in it's entirity is false and I have the backing of the Oil Companies safety officer, who intended to speak to my team leader. However, my team leader de-mobilises the same day as myself. do you have his support in writing? Not yet. But it is something I should take into account if I was to be eventually dismissed. I'll probably email him when I get back offshore.Thanks for the valid point. Have you considered simply looking for work elsewhere? If you think this workplace is staffed with people who are out to get you, why would you want to stick around? There's supposedly a labour shortage so you might even be able to get more money by moving. I am going through the process, of updating my CV. I have been invited to send in my CV, not too sure about this particular job. I am going to have a look at my options. But I prefer to work this problem out and stay on. So I don't have a cluewhat will happen next. I wasn't given my final performance improvement plan, because the team leader did not return on his last week. Nevertheless, I was called to the office in Aberdeen for a meeting. There is more to this. However, in the meeting I wasn't offered to make any comments, but was simply told they were going straight to a disciplinary hearing. I would like to know if I can record the meeting as there will be a lot of technical issues, which I believe will not be recordered in the way that is a true representation of discussions. The union will be present in the meeting and it may be company's policy that they do not allow recording; I am waiting to find out if that is their policy and want to know if they have a legal right to refuse the request. -------------------- STAND UP FOR YOURSELF OR YOU WILL FALL FOR ANYTHING

They can refuse consent to record, yes AIUI. But any subsequent tribunal may take a dim view of that if it means there is then some debate over what was (and also wasn't) said. It wouldn't seem reasonable to me for them to decline.
So how are you meant to comply with an improvement plan you've never been given seems an obvious question. Do you have a copy of the relevant policy/policies, you need to go over them in detail and call them up on every part of their own policies they aren't following, ignoring the moral rights and wrongs, failing to follow their own policies is pretty much fatal at tribunal. As above - you should ask about recording the meeting. They may chose to refuse.
BUT, unless they screw it up royally, you have the legal right to be accompanied by either a Trades Union representative (if you're a member of course!) or a company colleague. S/He not only 'sees fair play' but can be a very valuable resource to take 'your' minutes and compare to those issued by the Company. You should receive written confirmation of the accusations being put to you in advance - PM if you wish. |
