Hello!
I got a PCN for the ULEZ on bank holiday Monday after having the presence of mind to check that the congestion charging wasn't in force! I was aware that there are emission rules but have never really thought they applied to my car. I'm OK in low emission zones but not ultra low (I've checked online). I imagine that this one is a 'fair cop' as I was completely oblivious (a) to any need to pay attention to these rules, and (b) any signs or other warnings as I was driving into the zone. Ignorance being no excuse, of course. However, is there any hope of avoiding the £80 fine? Thanks -g PS: given there is ANPR everywhere, why not simply allow road users to be able to register for any fees and tolls occurred nationwide to be billed after the event, thereby removing the need to fine those who've signed up? I don't think this is semantics in that I'm not using 'rotated' and 'obscured' to refer to the same sign or signage issue.
There are two signs at the boundary, left and right, and two separate issues. The left one was rotated, which the adj considered. The right sign is obscured, almost entirely hidden out of view behind a traffic light unit and post. This issue was not referred to at all in the decision letter. I've contested a PCN before, even if your argument is totally valid they really drag it out as long as possible. Took mine about 9 months to get it cancelled. Each time it was awaiting them to send a letter (by post) and with no idea when they'd sent it. But once received they give you a limited amount of time to proceed. It gets escalated to higher departments that try to scare you off but allow you to pay the original 'reduced fee'.
You have to keep filling out more cr*p and for me it was a massive hassle, but eventually gets raised to the ombudsman, but at this point - the Council decide to 'cancel the ticket' without admitting anything was wrong with it. This means they can continue to carry on with whatever they were at fault with and hand out PCN for exactly the same incidents. I think it becomes less about the money involved and more about the amount of time you've invested in it.I think you may need to either prepare for the long haul and follow it through to the end. Or bail out with the lower 'reduced' charge offered. PLEASE post whatever decision you make on this thread and any updates etc. Just looking at the photos seems obvious the signs are not adequate, the fact they said you should've looked up the route on the internet is total BS. But it's not about common sense, its all about £Revenue. |
