Oh dear. I've got TWO NIPs from the Met Police, both on the A40 going in to London. One is for 76mph in a 40. One is for 68 in a 50. Both on a motorbike (CBR600F). The second one occurred after I'd received the first one, so I 'did not learn my lesson' after the first one came through and continued to speed, or so the prosecution may argue I guess. Both came through within 14 days. I responded (Doh!) to the first one by sending a letter (Not by registered post, just first class) to the Traffice Criminal Justice OCU indicating I was the registered owner of the vehicle, confirmed receipt of the NIP and asked could they send copies of any evidence they had. They sent me back by second class post a sheet containing photocopies of the original camera photos, plus some basic information about the offence. My 28 days to respond to the first offence is about to run out and they have not indicated any extension to this in light of my letter. So, I am now not sure what to do. I've spoken to specialist motoring lawyers(motoringlawyers.com) and they have recommended (They would, of course!) that I take on their services and that they are extremely likely to be able to acquit me on both accounts and possibly can also get most of the costs back from central funds as well. They recommend I do NOT fill out anything or respond further to the police and go for Failure to Furnish charges. However, their services could cost up to £2,000 per offence. This is actually not that unreasonable, having checked out a few solicitors, it's just a lot of money regardless. I asked about the PACE statement and they specifically told me not to send one off, as that reduces the chances of winning the failure to furnish charge. My current concerns are that I could end up with a £4k bill from them, plus two fines of up to £1k each for the two charges and I might end up getting banned anyway as I understand the court has the power to do that at their discretion. Whilst I want to keep my licence as clean as possible, I am worried about the large amounts of money involved and am starting to think about sending in my forms signed and taking the rap. Anyone got any advice? I know my case is a bit different from many I've read because of the two NIPs at the same time, plus the high speeds involved. Any help appreciated. |
