Hi all,
I received a parking ticket last week from a council warden. (Double yellows - parked there from 12:58-1pm whilst picking up a parcel from the store as no parking bays available.) The ticket was issued on a shopping centre where I work which is private land - the company who own the shopping centre (and the land on which it is built) confirmed that it is indeed private. As well as being on private land, the address on the ticket is also incorrect. Again, I contacted the owners of the shopping centre who confirmed that the street name on the ticket is absolutely not on their land where the ticket was issued. The street name on the ticket is (somewhat) in the vicinity of where the car was parked, but the car was not parked illegally on that street. I've searched around on the forums and on Google and I'm still unsure whether: a) a council warden can issue parking tickets on private land, and, b) if the ticket still stands considering the car was not parked illegally at the address stated on the ticket. There is one week remaining to pay the fine at the reduced rate (£35 instead of £70) so any advice you kind souls could pass on would be greatly appreciated. Many thanks in advance, PB |

Please post up scans of both sides of the PCN. Obscure the PCN number and your vehicle reg. Leave everything else visible; especially dates, times, location & contravention details. Host the scanned images on a site like imgur and copy and paste the img links into a post on here, don't attach or you will run out of space.
Post up a GSV link to the place where you were parked or as close to it as you can get. |

I had to get somebody at home to do it on my behalf. If you look at the little Google Map in the left corner, 'Manchester Road East' doesn't start until further up the road. The ticket was issued next to the Pizza Hut as you look at the image which is called Pembroke Street according to the private land owners. Either way, the car was not on Manchester Road East. It was actually nearer to High Street than it was Manchester Road East, but even then, the actual name of the road is Pembroke Street. Thanks again, PB |

Ownership of the land is irrelevant, what counts is whether the location where the car was parked is a highway, in the sense of a way upon which members of the public have a right to pass and re-pass unhindered. Generally in a shopping centre there is no legal right, and you can pass upon it only because of the implied consent of the owners. So what you really need is a letter from the shopping centre confirming your car was parked on private land and there is no public right of way upon that land.
It would also help if you could upload the council photos, and a link on google maps to the location where you were actually parked.
