Hello
I would need your help with something relating to a Private Parking Charge I received from Parking Eye following vehicle overstay at an ANPR controlled car park owned by Lidl. The driver was genuinely shopping there and has the receipts to prove it but nevertheless did exceed the allowed parking times due to delays in store (very busy) and shopping for two households due to covid isolation issues. I have been reading and consulting threads, forums and groups and do feel a bit lost as I do not always understand the legal terms used and processes involved. One thing that has stood out but I am not sure how to find out about it is whether the contract between the landowner and the PPC includes what I have seen referred to as a "hidden" genuine shopper clause. There are signs in the car park stating the contract T&Cs between the PPC and landowner but would that be the full content of the contract? I have contacted Lidl (local store and customer service) for help either cancelling the ticket or offering contract info but they have just referred me to the parking company and point blank refused to help in any other way. Therefore I will send my appeal to PE and I was wondering whether I can demand to see the contract for any "discretionary criteria"(?) such as the genuine shopper clause. Do you know anything about this? Any help and advice would be greatly appreciated. Many thanks |

forget the clowns reading a script at head office , you photocopy your NTK with details on , and write on it your phone and email , and go into the shop to speak with the manager
due to them saving money by using reduced staff , you have an invoice , and you can tell him that!! give him NTK and ask him to sort it BUT , as mentioned on MSE , it is unusual for lidl to be in bed with PE , athena (?) usually sleep with them , perhaps the reason lidl head office cannot assist * may be the fact that this shop is in a shopping clomplex where they are one of many shops and the managing agent has hired them * did you state the location , to lidl customer services before they fobbed you off ? either way , most managers have ability to sort tickets out , so try the manager This post has been edited by freddy1: Sun, 11 Apr 2021 - 22:50 |

The sign states that PE are authorised by the landowner to operate the car park, but saying that, the landowner is not mentioned on the sign, I just assumed Lidl were. When I took the NTK to the local store manager saying that they were the landowner so they should be able to do something about it, he didn't deny Lidl being the landowners, just said there was nothing they could as the car park was managed by PE Been trying to get the email of the CEO or MD but only getting a postal address and the email address "dispute.resolution@lidl.co.uk" under his name (Christian Härtnagel) and have CCed this address in my replies to Customer Services. No luck |

Next time you go to Lidl, get the biggest trolley, pile the trolley high with small stuff you don't really need from every corner of the shop, leave it by the check out and walk out. Maybe leave a note in the trolley saying you're a disgruntled shopper and the same may happen again if they don't deal with your parking ticket. Also tell them their German-owned rivals are more customer focussed.

Parking Eye have cancelled my PCN!! Pretty quickly too, after I appealed as a genuine shopper, sending my receipts as proof!!
I have been told by an MSE forum that PE will generally cancel penalties for receipts evidence (over £30) proving you are a genuine customer onsite. Thank you very much for your support!! |
