Hi,
I received an s172 about a month after the alleged offence, 40 mph in a 30 mph zone. It s a lease car hence why it was revived a month after. There is photographic evidence but can not make out driver, picture of driver is too dark and not legible. I have named the driver and provided the address it is a person living in in another European country. A month after submitting the S172 I have revived a letter from the Police stating "the Police have been unable to affect service on the on the nominated driver at the given address" They have given a few options, 1, Supply phone and email address of contact so they can continue enquirers. 2, nominate someone else as I may have made a genuine mistake. And then finished off the letter with if no further correspondence is received within 14 days they may put the file before magistrates for consideration. The person who had the vehicle at the alleged time for offence has stated they have not received an NIP. I'd be interested to hear advice on how to deal with this as I've been brought before the courts before by the CPS when someone claimed i was driving their car when i wasn't and the case was dropped as there was no evidence but very stressful experience. Should i go back to police with more info? or ignore or deal with this entirely differently. I believe they have not made any attempt to contact the driver whihc may inconvenience me. Regards, |

Ignoring police requests rarely ends well. Are you certain you supplied the correct address?

If you are sure of the identity of the driver, it is in your own interest to provide the information, and help them make contact with the driver.
Whether or not they make contact, they may ask you for evidence that he or she was insured to drive your car at the time of the offence. Alternatively, if you have made a genuine mistake, they are offering you a lifeline. |

When the lifeline mentioned above is offered it's to prevent the possibility of a much more serious offence which involves the potential of a custodial sentence.
I am not in any way suggesting that a fictional driver has been nominated however this is probably the police's suspicion, as the nominated driver hasn't responded. Best plan forward is to provide as much contactable detail as possible. |
