Date of the NIP: - 66 days after the offence
Date you received the NIP: - 68 days after the offence
Location of offence (exact location as it appears on the NIP: important): - A4601 Wolverhampton Road. Cannock (086)
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - First
If your are not the Registered Keeper, what is your relationship to the vehicle? -
How many current points do you have? - 3
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - I'm not 100% sure I was driving - I don't remember being over that way on this date, so I'm thinking of asking for a picture. It is alleged that I was doing 40 in a 30 limit, and the info with the NIP gives the indication that I might be offered a speed awareness course. If I ask for a confirmation picture rather than just naming myself as the driver, will I lose the option of taking the course?

No. Remember that there is a time limit to take the SAC and also only 28 days to reply to the NIP regardless of whether they give you a picture or not.

They will usually offer a course up to 4 months from the offence. (This is to ensure the 6 months to prosecute is not breached - 'timeout')

Your wizard answers are a bit wacky? You are the registered keeper but it arrived after 66 days?

If it is a fixed Gatso camera then a photo will not assist in identifying the driver. It is a long time ago to remember who was driving, do others use the car?. As Jlc alluded to, an explanation of the delay would be useful.

Yes - I'd recently moved house and been a bit slow to send my V5 in, so I assume they sent one to the old address first. My new document date is after the date of the alleged offence.

Yes - I suspect it's that camera. I am over that way occasionally, but don't remember being there on the day in question, hence the photo query. I'm more concerned about cloning, as the only two people who could feasibly have been driving my car are myself and my wife. I know it wasn't her as she hasn't borrowed my car in a long time as she has her own - and I dont remember being there. I didn't realise fixed Gatsos wouldn't assist in driver identification though?

They can inasmuch as sometimes the build of the driver can be seen, if your wife is of a different build you MAY see the difference.

Cloning, whilst is does exist, is rare & often the cloned car will be used in an area far away from the legitimate vehicle for obvious reasons. So ask for the photos if you feel it could help, but bear in mind your time limits for naming the driver, as this could get very expensive for you.

Asking for a picture should at least assure that it is your car, and not a misread of the number. TBH if you go there sometimes it is very likely that it is indeed your car.

Well, my initial reaction on opening the envelope of "WTF - there's no way I was there at that time on a Saturday morning!" has now been replaced with "actually, maybe it was me....."
So, now I'm pretty much resigned to admitting I was the driver and accepting the consequencies. The problem with these cameras is you can't "accidentally" show the copper your Army ID card as you're getting your licence out, and hope he'll let you off with a warning.....

True but neither can you run the risk of AGAI action if he decides to report you. There are some funny people out there...

My cap on the parcel shelf used to help with real coppers (twice at least!)
