Hello, i received a SJPN and plan on pleading guilty, my question is when do they look at it? you get 21 days to return so do they look at the case on day 22 or longer?

What's the allegation?

No license/insurance, although im now full licensed and insured. i purchased a car from 3 roads down and decided to drive it home to park on my drive. turn out police car was on its rounds Give us the full story, you didn't just get a SJPN out of the blue. Where you stopped by police at the time? Were you actually driving with no licence and no insurance? Yes i was driving, I got pulled over just as i was coming into my road after picking the car up. this as 5 months 23 days ago. i done my test and passed just 5 days after getting pulled over as this was booked already. my question is when do the courts read my SJPN, day 22 after its due back or at a later date. |

Yes i was driving, I got pulled over just as i was coming into my road after picking the car up. this as 5 months 23 days ago. You're not hoping that if it gets to 6 months they can no longer try you, are you? -------------------- Regards,

The single justice procedure basically puts the pleas into a pile and a single justice and legal advisor work through them, it will be at least a few days after the required return date, up to two weeks, not that it makes any difference.

The single justice procedure basically puts the pleas into a pile and a single justice and legal advisor work through them, it will be at least a few days after the required return date, up to two weeks, not that it makes any difference. No licence or driving otherwise than in accordance with? And no insurance presumably? i done my test and passed just 5 days after getting pulled over 6 points for no insurance will see your DL revoked by DVLA. The numbers are convoluted but revocation is triggered by getting to 6 or more are after gaining a full entitlement, so you can start from 0 and gain 6, start from 3 or more and gain 3 or more, either triggers revocation. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

Right. He will have 6 points on his DL. Any further endorseable offence within 2 years of gaining full DL will cause revocation. Correct. It is not a well drafted piece of legislation, the really bizarre thing is that disqualification, which is clearly more serious than 6 points, does not trigger revocation. The justification for revocation is that the driver has demonstrated that he is not a careful and competent driver, and so needs more experience and can then be tested again, and it is not a punishment. If that is so, it should apply only for bad driving offences committed on the road, not to paper offence like no insurance. -------------------- |

The clue is in the relevant statute, but if you can't find it, the trigger is an offence committed within the probationary period which takes the total of relevant points to 6 or more - so if he has 6 or more relevant points (less than 3 years old at the date of the subsequent offence) and then receives any further endorsement that would be an offence committed within the probationary period which takes his total of relevant points to a number which is greater than 6. -------------------- Andy
