Hi all,
Looking for help and a bit of guidance on this PCN. i have just opened a PCN addressed to myself from Premier Park. Only just opened due to me misplacing. They are alleging that the drivers parking session expired or was unpaid. the details of the PCN are below: Issue date: 01/03/18 Entry time: 19:09 04/02/18 Exit time: 21:22 04/02/18 (duration 02:12) Premier park are asking for £100 reduced to £60 if paid within 14 days of issue. That has now expired. I am not the registered keeper of the car - it is leased. I am a customer of the Casino The PCN states the Terms of parking on the private land are clearly set out on the signage within the car park. I dont think it is (https://imgur.com/gNxdSgF) There is also a 50P charge for paying by card - i thought this was abolished at the start of this year? Where do i go from here? You post is hinting a possible driver. Edit to use "the driver....." etc.
Is there more than 14 days between the alleged date of the alleged contravention and the date you received the form (assumed to be 2 days after posting)? If this is truly a lease car then check if the lease company have received a PCN and named you as the hirer. If so then with your PCN did you get a copy of the lease documents and the original PCN? |

Hi,
The contravention date is 04/02/18 and the date of issue is 01/03/18 (25days) I have had no contact from the lease company to tell me they have nominated my details. |

What Ostell is getting at is that Premier has almost certainly failed to meet the conditions of the Protection of Freedoms Act to recover payment from the hirer
This requires that Premier sends you a copy of your hire documents at the same time as the PCN Most lease/hire companies will tell you if they've received a PCN Otherwise they can't invoice you for their £36 "admin charge" ? |

understood.
the only document i have received is the PCN with Zero contact from my leasing Co. i know i should be appealing this but unsure as to the grounds and how to compile it. |

Failing to comply with the requirements of POFA paragraph 14. Especially the bit about you PCN should have copies of your contract. POFA fail = no keeper liability

There is also a 50P charge for paying by card - i thought this was abolished at the start of this year? A bit of confusion on this one. Companies can still charge a 'booking' or 'admin' fee as long as the charge isn't only for paying by card for that 'service'. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

"please be advised that all card payments are subject to a £0.50 platform fee" |

However its not hugely relevant, as you wont be paying... |
