Hello,
I hope everyone is well and safe during this trying time.

We just found this penalty notice issued on behalf of Saba Parking Solutions. We did pay the full daily amount, but this was before 4pm on the day.

Consequently, this recored as failing to obtain a valid ticket.

What to do now?

Read up on some of the other SABA cases on here and it will give you a lot of background information very quickly.

You have the notice sent to you as the registered keeper, please EDIT your post so there is no indication of the driver ID at all, use 'the driver' to describe what happened, no I, we they, he or even the dog.

There is no keeper liability but there is driver liability, so make that edit now please.

The notice is deliberately misleading, they can only clamp for an offence in progress and not for one they allege an unknown driver of the same car committed on some previous occasion.

And complain to the BPA that their notice is misleading and pretends that they have more power than they actually have

Photos of the signs would be appreciated. The parking is described as all day parking in the payment.

I'm actually confused.. your receipt says you paid for the parking at 3.22am for a full day ticket. Is that correct?

But then the "1 Day" ticket stop and start times are often defined on the signs. The signs are needed.

Clamping without lawful authority has been illegal since 1 October 2012. Railway Byelaws 2005 mention clamping but this is going beyond the underlying legislation, Transport Act 2000. It was only allowed due to the common law in force at that time. Since use of clamps has never been explicitly approved by Parliament, there is no lawful authority. So tell them to get stuffed.

yes; but they reset the clock at 4am...confusing! I had t pay early due to airport travel. the car entered after 4am, but my assumption was is was already paid. So yes, confusing!

I am not sure I follow. Will they come to your address and clamp the vehicle or clamp it next time you park at one of their car parks?

All clamping is illegal (a few rare exceptions)

NCP tried the clamp and remove trick in a railway car park. It cost them 10's K in the resultant court case

They won't be coming anywhere near your property and their threat to clamp you at the station is just that - a threat (pretty empty and arguably illegal). We know of no such SABA case of clamping at any station.
