I posted on the Moneysaving Forums and was recommended this forum for some advice.

Just looking for some advice, long story short I received a notification today that I was speeding on a road 45mph in a 30mph. I’ve always travelled on this bit of road for over 14yrs (and wrongly assumed the speed limit!)-my worry is that they caught me on the 3rd January, but as I always drive on this road, I always do the same speed, so now I risk the chance of getting caught again, if I haven’t been already.

I’ve ticked the box for consideration of a speed awareness course so hoping I’ll be considered for that, if I get caught/registered again between the time of the 3rd Jan and today am I likely to lose my licence and get a conviction? I’ve never had any speeding or car problems before this and having been in two serious car accidents as a child, I get why limits are in place! My fault for assuming the speed limit of course.

45 in 30 is too fast for a course, you will almost be offered a 3 point & £100 fixed penalty. You would only likely be in line for ban if you were caught another 3 times and reached 12 points.

How was the speeding detected, manned or unmanned?

Are you thinking there might be more in the pipeline?

As above, if it's an unmanned camera you may have been caught multiple times and this is the first notification.

Which road is it?

A surprising number of people assume that a dual carriageway is automatically a 40mph limit, but this is not so, and I wonder if that has caught you out. If a road has a system of street lighting, with lamps no more than 200yards apart, it is a restricted road with a 30mph limit, unless a different limit is signed. As you always drive this road but have only once been caught, it sounds as though it was by a camera van or someone with a handheld device by the side of the road, that does not monitor that stretch of road very often or you would have been caught or noticed the enforcement before, so I would not worry too much about having been caught on another occasion.

As above, 45 is too fast for a course, which are offered up to 42 in a 30 limit, and are not offered at all in Scotland currently. Therefore a fixed penalty is the likely result.

It says I was caught by manned equipment, I assume that means a police van or hand held camera? And no, never previously been caught, I don’t know how long they have manned equipment on a stretch of road for so was worried in case I got caught the next day or something.

Ok, that's probably good news as mobile enforcement doesn’t tend to stay too long in the same spot.

Unlikely they would target a particular spot continuously, they might only be there for a session and not return for weeks/months.

What is the location?

There was a question either on here or another forum where at least two contributors believed a dual carriageway automatically bestowed a default minimum speed limit of 40mph. They were both unaware of the "system of street lighting" restricting a road to 30mph and believed that the only time a dual carriageway could be restricted to less than 40mph was if it had terminal signs and repeaters. I can't find it at the moment but the gaps in their knowledge was quite alarming.

Yes thanks, Fredd. In fact it was even more alarming than I remembered:

“When I learnt to drive we were taught that dual-carriageways were 70mph limit unless in town with street lights which was then 60mph limit unless stated otherwise,”

“Well it seems I am not the only one who has never heard of these 'Restricted Roads' before, discussed this in the pub last night and almost everyone said the same: that dual-carriageways are 70mph unless with street lights which is then 60mph. The only person with a different answer happened to be a copper and even he still wasn't completely sure, he seemed to think it was down to the spacing of the street lights, if below a certain distance then 30mph else 60mph but didn't know the distance.”
