Hi
Does anyone know if the adjudicator is allowed to adjourn the hearing everytime I raise a point. I went to the first hearing on 2 December 18 and I raised some points but he would not let me speak at all to put my points cross and explain why I raised the points, he then said he will adjourn and I should put my points in writing and send it in so that TFL has the opportunity to respond, I sent a detailed letter with my points of dispute with supporting evidence and I also received a charge certificate asking to pay within 14 days, I then attended second hearing on 3/2/19 and tried to explain my points again the adjudicator not willing to listen to my points and my points that I sent was not sent to TfL and i told him that the yellow box is not according to the diagram authorised by Secretary of State for DfT and he said it does not need to be as it can be as TfL wishes and that he is going to adjourn for another date so TfL can have an opportunity to have a say on my points of dispute. The adjudicator I have found to be very biased towards TfL and very patronising. Anyone has any advice on this matter. |

That's everything I got form parking tickets. IMO the appeal is a real mess and the fact that we haven't seen the video makes this all the much harder. TFL have submitted a load of nonsense about repealed regulations and redundant authorisations, but the strongest point by far is the premature service of a charge certificate.

OP, would you please answer the simple question:
What is the status of your appeal? Pl do not give us reams of narrative, just tell us whether it has been determined or not and if not has it been postponed or adjourned and what directions the adjudicator has issued. At present you and TfL make a good pair: neither knows the law (I cannot remember a worse example of misquoted legislation) nor can order their thoughts coherently and succinctly. In addition, both think that weight of evidence should be taken literally. So what you might or might not be able to do at this point is contingent upon the status of the appeal and directions. |

OP, would you please answer the simple question: What is the status of your appeal? Adjournment letter 2 makes it pretty clear cut, the case has been adjourned to 23rd March at 12:00. My view is quite simple, we should make a submission that: 1) Issuing a charge certificate while the case is subject to adjudication means the penalty must be cancelled, as the amount demanded exceeds the penalty due 2) As a secondary issue, Eyong Besong v Transport for London (case reference 2180132152). parking tickets, if you can show us the video we might be able to say something about the contravention. Unfortunately most of your appeal is, frankly, rubbish, but luckily TFL's mistakes are so serious that you can win anyway. -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php
