Hello,
I have received a Notice Of Intended Prosecution for exceeding a Variable Speed Limit on the A64 Leeds on 27/06/2018 I received the letter on Saturday and assume it was so late as I was in a hire vehicle hired through my employer. The notice states "The speed limit of the vehicle on this occasion was recorded at 47 mph (not recorded for red light offences) For variable speed limit offences only, the speed limit at the was mph" So it does not clearly specify what the speed limit was at the time? I an earlier paragraph it does state as below "Exceed a 40 mph speed limit in contravention of a local traffic order - automatic camera device at 13:34 on 27/06/2018" But then goes onto detail the offence "The speed limit of the vehicle on this occasion was recorded at 47 mph (not recorded for red light offences) For variable speed limit offences only, the speed limit at the was mph" Is this a ground for appeal or am I just wasting my time? No grounds for appeal, and in any case, you can't appeal a NIP.

It is perfectly clear, the speed limit was 40mph the speed of the vehicle was 47mph. You may have confused yourself by inserting the word 'limit' there. If there had been a variable limit in force, they would have put the limit in the last line, but there was not, so that has been left blank.
Did your previous offences result in you attending a course? Did they result in you getting 9 or more points? If you have not done a course for offences committed in the last three years you should get the offer of a course. If you are not eligible for a course, you should get a fixed penalty of £100 + 3 points, unless you have 9 or more points on your licence, in which case it will go to court and totting (getting 12 or more points) may be an issue. -------------------- |
