Hello everyone.
I appreciate any help regrading this. In Sep 2021, I drove through a School Zone by accident. I did not get the PCN so I did not get the chance to pay the discounted rate. Then in Nov 2021 I got a letter saying I have to pay it in full. I wrote back saying I did not get the Original PCN. They never got back to me until now, 18 months later with the attached letter. The first question in the FAQs hints at what to do - you wait for the order for recovery (OfR) and then tick a box saying you didn't get the PCN. This cancels everything but they can reissue the PCN.
And the long gap in the process should see you get that cancelled too. The key is not to miss the OfR and we recommend calling the Traffic Enforcement Centre at intervals to check is the debt has been registered. Is the address on the charge certificate completely correct. |

Read this page https://www.londontribunals.gov.uk/eat/unde...rcement-process in particular the paragraphs at the end of the page titled "Registration of Debt and Order for Recovery" and "Statutory Declaration".
Once you've read that, if anything isn't clear please ask. I would recommend you keep checking the amount due on the council website, as soon as it goes up to £204 you can make a statutory declaration, you don't need to wait for the Order for Recovery to come in the post. -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php

I will wait for OfR to come through. and yes, the address is correct Had a read through that link and it all makes sense. thanks. just a few Qs pls: - once the OfR comes through, if i say i didn't get the pcn, will that simply be the end of storey, or will i need to draft up a letter and send evidence etc, just like an appeal process? - on what grounds can I get the PCN cancelled if it has taken long? and who do i take this up with? - if a debt has been registered, what does that mean? will they cancel it if i end up ticking the box on the OfR saying i didn't get the pcn? sorry if my questions seen daft. i am new to all this. thanks in advance. |

No evidence is required, just a tick to say you have not recieve the PCN. You would need to get it sworn by officer at Magistrate Court or County Court, otherwise a solicitor can do this for a cost of around £5 to £10. With the correct process with in time Statutory Declaration, they cannot reject it. You would have to take it up with Traffic Enforcement Cente, you cannot do it now until Ealing Council registers with them but Ealing Council is famous for taking it too long could be over 1 year! |
