Hi everyone ,
First post here so hope I'm in the right place. I was recently parked on double yellow lines however seen a PCSO issuing tickets outside and proceeded to move my vechilcle before she had the chance to start writing out an actual ticket however she told me that she had noted my reg plate and would be sending it in the post however I still moved my car . Sure enough I came home today to a Fixed penalty notice however the actual ticket which would have been attached to my car has been sent in an evelope with no cover letter. Is this the correct way to enforce this. She has also filled in the the PCN stating that the driver was not seen however this is incorrect because as I mentioned above actually engaged in conversation with the PCSO and moved my car before she had the chance to issue the ticket. I know really I should pay as I shouldn't have been parked there however it has sort of been a issue in the community as a lack of parking available in the area has meant previous PCSO's refuse to ticket us as she agrees that the issue needs to be sorting so sort of a lack of consistency here but none the less I was parked there and got caught however have doubts that this has been issued in the correct way. 'Issued in the right way' is much harder when it's pursued as a criminal matter (rather than decrim via a council). The officer can attend as a witness should you want to challenge it.
Generally these should be paid or if you do want to challenge then you must proactively request a court hearing. (Otherwise they automatically increase by 50% and become registered as an unpaid fine with no recourse) Pleading not guilty has its risks at court - not least large prosecution costs should you lose. If you don’t pay the fixed penalty and it goes to court anything about the fixed penalty is irrelevant, it becomes a nullify. You either have a defence to the allegation (it sounds like you think not) or not, if not the FP is the best offer you’ll get.

Thanks everyone , I have however just noticed the officer has misspelt the road I was parked on.
