Hi, I've been looking through this forum and really impressed by the dedication of everyone! Thanks for keeping up the good fight!

I am the registered keeper of a vehicle which was parked by the driver in the Weatherspoons Green Parrot Car Park in Perranporth Cornwall. The driver thought that the car park was for customers of the Weatherspoons and didn't notice the pay and display signs. When the driver parked, it was summer in Cornwall, there were a lot of vans and it was heaving. The driver went into the Weatherspoons and purchased dinner and a couple of soft drinks.

As the registered keeper, I have now received a notice to keeper, as the carpark had anpr.

What is really frustrating is that a customer of the Weatherspoons gets to have their £2 parking ticket refunded when they purchase something. Also, the driver saw so many people not paying for parking as they also just thought that it was a Weatherspoons carpark. ECP must be making an absolute fortune!!!!! It would be great to be able to post a win against ECP here, as this must be affecting so many people.

As the registered keeper, I received a parking charge notice. I have been reading around the forum and there are a couple of threads which seem relevant.
There is one thread which was started last summer (http://forums.pepipoo.com/lofiversion/index.php/t121844.html) regarding this car park, but ended with cabbyman saying look at his Gatwick thread (http://forums.pepipoo.com/index.php?showtopic=107154)

Before I draft a response to ECP, it would be great to have some advice as I feel that some of the Gatwick case mistakes in wording/response by ECP have now been ironed out by them. So I just wondered if you thought that the Gatwick case was relevant. So here is my general argument below and please can you let me know if it sounds worthy for a response.

The driver genuinely didn't spot that the car park was pay and display and assumed that it was for pub customers. The narrow entrance, full of signage gives this impression and not that it is a normal pay and display car park. So the main argument I want to make is that the signage isn't obvious for a Weatherspoons customer. I will attach some images of the carpark. Firstly, I would say that the pay and display sign on the entrance is lost within the other really busy signage. If you are going to the Green Parrot, you read the Green Parrot sign and the rest are lost. Then if you take the route marked in yellow and back into that space and walk to the pub, you are not aware of any signage, particularly if there are lots of tall vans. There is no sign by the pub entrance!

I am aware that the first response to ECP needs to be one basically just stating bad signage and request a POPLA code. But does the general argument above sound alright, or should I also basically hit them with all of the things in the Cabbyman Gatwick response? Here are the relevant points I feel that I can use, but I have no idea whether they are true to this case (apart from the signage). Is it best to just throw it all at them an hope for the best?

1) No keeper liability
2) BPA Code of Practice - non-compliance to guidelines
3) No landowner authority
4) Lack of signage- unclear signage
5) The ANPR system is neither reliable nor accurate

I really appreciate anyone who could help me out with this!!!!!!!!!

The PCN is not POFA compliant and therefore the keeper cannot be held liable.

No period of parking. Moving in front of a camera cannot, by definition, be parking 9 2 a
The creditor has not been identified 9 2 h
The invitation to the keeper is not there 9 2 e

You will find suitable appeals within the forum
