It's my first post on here so i'll try to be as detailed as possible...I like in UK, accident happened around Hemel Hempstead area
I received a letter home from a solicitors company regarding an accident I've had over 3 years ago while working for an agency (delivering for amazon). I just got to find out that there was no insurance on the van and that I'm being taken to court for driving uninsured by the solicitors along with Mib ( Motor Insurers' Bureau ). The person i was working for (my boss) has now told me that it was my responsibility to insure the van as a self-employed, but all vans must have insurance to comply with Amazon's rules. Other drivers at this agency had issues in the past with this agency regarding insurance... aka Amazon themselves checked insurance on all his vans and they were showing as RED. However, he managed to show Amazon the insurance certificate and said it might take time for vans to show as insured. I've also had a different accident a few months before the one i've mentioned above... while police attended the scene they were struggling to find insurance for the van, I've then called my boss and he was assuring them that the van has insurance... After 15-20 minutes police came back to me and said that it was just an admin error and that insurance is now showing GREEN and all good. (The van is not under my name!) I have no proof of anything since this happened over 3 years ago. I have to attend court and it looks like I might have to pay over £10k and have my license taken for driving uninsured (bare in mind i got my boss to confirm that the van is fully insured over the telephone). After I called him today he refused to give me proof that I was insured during the accident and that It's my problem to explain to court why I was driving uninsured....however the letter I received has my surname spelled wrong (not sure if this matters) What are my options? DVLA is a red herring - a leased van - think you said from Northgate - was never going to be registered in your name. Nor if it was owned by KMI.

A word of caution, do not think that if the MiB handle this, the problem will go away. If the MiB are required to pay out under the uninsured driver scheme, they will then come after you for the money. You therefore want the MiB to determine what the insurance status of the van actually was, they would know as they maintain the insurance database.

Have you acknowledged the claim online? You have 19 days from date of issue to do so or they can request a default judgement and you loose, no ifs buts or maybes. I did not, i wasn't even aware I was supposed to, how do i go about it? Have you acknowledged the claim online? That sounds like a "you problem". However, I will try to help - either it is there, in which case you need to learn to read, or it isn't, in which case you need to do something about it before it becomes a bigger problem. Or not.

Why don't you just show us what you received? See post #1... I would call the law firm that sent the supposed claim and ask them what he is supposed to do. As I said I think this is really aimed at getting something out of MIB and they know full well the OP isn't in play. |

The date on the claim form was 13th September. The ambulance chasers letter 10th January.
That seems a big gap. |

I checked, they served 1 day before the end of the limitation period, the claim form would have expired on the 13th. At this point Advicelisters needs to *urgently* file an acknowledgment of service, if he contacts the solicitors they'll just apply for a CCJ in default. The form is here https://assets.publishing.service.gov.uk/go...2450/n9-eng.pdf and given we're past 14 days from service, I suggest you send it to the court by email: enquiries.northampton.countycourt@justice.gov.uk You can just fill it in on your computer, there's no need to print and sign, just typing the signature is acceptable. Don't forget to put the names of the parties and the case number in the subject line, and put a contact telephone number in the email so the court can contact you if need be.
