Please do not post personal details for obvious reasons - My husband was driving the car at the time. I believe Audi hold the V5 document but I have not received any notification from them that they have been asked to provide my details. This notice was the first indication that they intend to prosecute. I believe they are out of time as they have taken over a month to send this to me?

The only time limit applies to the first NIP, which, as you say, will have gone to Audi.
They had 28 days to reply to the police, and no obligation to notify you.
I'm afraid everything seems in order, and you must respond nominationg your husband.
If Audi hold the V5, it would seem logical to assume the first NIP was sent to Audi since the police won't know you are the regular driver. Audi will have had 28 days to name you as the keeper.
There is no time constraint on subsequent NIPs in the chain.
There is no requirement for the RK (in this case Audi, or more likely an Audi finance/leasing company) to notify you they received a NIP, their only obligation is to respond to whomever sent the NIP.
Is there really a need to repeat the same information in several posts?
