Hey guys,

There is a carpark on my road which is generally for the residents of the flats associate with that carpark. Historically anyone has been parking there as there was no enforcement. As there were permits introduced to surrounding roads, we found that more people started using the car park and one of the residents must have got their landlord to take action:

First big signs with huge prominent words were plastered around this carpark "PARKING IS FOR THE RESIDENTS OF *ROAD NAME* ONLY" which I thought, great as it includes us given that we live on this road too.

Then a few months later it looks like control was contracted out to Parking Control Management who placed further signs around the carpark - I've attached an example of the signs they put up. This sign suggests that a valid permit needs to be displayed.

Only this morning at 7am tickets started being issued to any car without a permit. I'm aware that this is not a penalty or fine, but a notice to keeper. I am wondering what is my standpoint here, I don't wish to pay it, I've been told I can't ignore these tickets.

Based on the previous signs which are still there, can I claim I'm liable to park there (citing errors in PCMs signs at all)? It would make life a little difficult if I couldn't use the carpark so it would be awesome if they can't enforce tickets given to residents but I'm aware this may not be the case..

If the address on the NTK was correct then it sounds like they DID apply to the DVLA (as advised, after day 28, with a view to delivery of the NTK prior to day 56). You would need to check with the DVLA to be absolutely certain.

Ah okay I misunderstood before.

So this NTK seems compliant with POFA? I'll appeal as the keeper and do as advised, ignoring all correspondence until a letter before claim.

Hey all,

So I know the advice has been to ignore. Just received this letter to reject my second appeal, which I know was expected.

My question is, is it worth appealing to IAS as stated in the letter? Or do I continue to ignore?

By ignoring I know there's a chance this can go all the way to court, does anyone here have experience with a similar case and whether there's a chance to win or would it be 50:50? The only reason I ask is because the RK is a little hesitant to forego the discount and is tempted to pay up. Would be good to have some assurance before advising the RK.

There is always a chance to win, especially with signs.

Check with the DVLA to see if they did access you details. SubjectAccess.Requests@dvla.gov.uk

Hey all,

So I just wanted to come back to this. There isn't an update to this particular PCN as they stopped chasing for now it seems. However I wanted to see if anyone has any specific knowledge on these things:

Since this ticket we didn't park on the carpark for a while and over the months I noticed that I never actually saw anyone patrolling so members of my road parked in the carpark overnight a few times. We've done this many times this year without any issue but not with the car that originally got the PCN. However last week, the FIRST time the car was parked in the carpark again since the original PCN, I got a ticket the following morning (7:30am on a Saturday). I saw from my CCTV that a black Audi had pulled up, parked next to the car, moved away then took photos and drove off. I'm finding this behaviour a little strange. How is it that we have parked 2 different cars there many times without any issue but as soon as the first car was parked there again, it gets a ticket straight away.

I agree that the land is owned by the housing association and pcm are managing it and we aren't tenants of said housing association. But I find it super strange how they've seemed to target the same car? Does anyone know how often PCM do patrols, or would one of the tenants have to report it. I am going to fight the new PCN but I've been racking my brains trying to make sense of it..
