Hi

in 2017 a car was parked in a rough car park area but it had small signs as i later went back and checked i have uploaded the claim form with
the pictures of the car park and the signs and locations of the signs.

a sticker pcn on the car screen and then letters.

now the county court claim which i know i need to reply to just wanted the best way to reply so i thought best to take some pics of where the car supposedto be parked was parked,

Do not hint at the relationship (if any) between you (the registered keeper who has received the claim form) and whoever drove on the day. Edit your first post to say "the driver parked", not "I/my wife/my dog parked" etc.

Post a copy of the claim form, along with any pics of signs, PCNs, appeals or replies on here, fully redacted of identifying detail, so that we can have a look. Host at TinyPic or Imgur.

Acknowledge the claim online, leaving the defence box totally blank. Tick defend in full. Do not contest jurisdiction.

please note the bays are only in certain areas of the car park and the rest of the car park has no bay numbers









also several cars parked in non numbered bays not in numbered bays and also the car park barrier has never worked in the last 5 years as i asked around

the letter b4 the claim was not received as post was not forwarded this was the only one that was sent on as working away and the label on the car was binned

have not acknowledged yet i will do the claim was a few days before the end of sept

'A ferw days before the end of September' could be the first onwards!

We need to know the date and, therefore, the deadline we are working with.

Search the forum for 'BW particulars of claim.' You may find a letter asking for greater detail including copies of any letters or notices they intend to rely on.

Post here for comment by others after drafting.

The first sign at the beginning of the car park area i think is not legal the words not seen easily at the bottom are the words clamped

I have found this which i feel i should send to bw legal to reply to

1. What is the basis of the claim? How has [Claimant] asserted the defendant , who is the Keeper of the vehicle, has liability when it is not known if they were the driver on date of event?
2. Is [Claimant] making a claim as an agent of the landowner or is [Claimant] making the claim as occupier in their own right?
3. Is the amount claimed by [Claimant] for a genuine pre estimate of loss for a breach of contract or a contractual sum?
4. If the contract has been conveyed by the use of signage on site, please provide copies of the signs on which you rely and confirm these are the signs in situ on the date of the event. Please also provide the date these signs were installed, for example, a works schedule, maintenance record or invoice for the work.
5. Were there signs at the entrance to the site on the date in question? Did these meet the British Parking Association's Code of Practice Appendix B (Entrance signs) or the Independent Parking Committee’s Schedule 1 (Please indicate)
6. Provide a copy of the PCN Terms and Conditions on date of event

No, youre asking them for a copy of all documents they hold, and will be reliant upon. State tey should already be in possession of these documents, as part of their professional diligence, and therefore you require them within SSEVEN days from date of service of this letter.

Acknowledge. Today. Online. DO NOT DELAY. Do not enter anything into the defence box, do not contest jurisdiction unless you live outside england and wales.

Then get a defence together. Once acknowledged you have 33 days from DATE OF ISSUE for the court to recieve your

and EMAILED PDF of your defence.
