hoping to get some help here 1. The offence occurred in London 2. Constabulary : Met Police 3. Date of the offence: 19 mar 2005 4. Date of the NIP: 19 Mar 2005 (verbal at road side) 5. Date you received the NIP: 19 Mar 2005 (verbal at road side) 6. Was the NIP addressed to you? N/A 7. Was the NIP sent by first class post, second class or recorded delivery? N/A 8. Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? If not then what is your relationship with the vehicle? I am the Registered Keeper. . 9. Do you hold a UK or foreign driving licence: UK 10. How many current points do you have? 3 points 11. description of events: Driving down a deserted rural road at around 1am on a Friday night, Driving conditions were very good, had been a relitivly hot day & night, no rain or frost Once i had got to the end of the road i was pulled over by a Traffic T5, i was then told i had been clocked at 78 MPH & then shown the device which was showing -78 on the back of the gun (because i was caught going away from them apparently) I was then issued a Verbal NIP at the side of the road & advised i was being reported for the offence of excesess speed. 4 months later i recived the court summons & under instruction of my soliciter i pleaded not guilty, I have now reviced my new Hearing Date Idealy i'd like some info on the following Reading up on the Pro Laser 3 i am hearing lots of stories about the home office approval being removed & stories about this device being very in accurate. is this true & could this be used in my deffence Also when i go to court & try to contest the accuracy of the device what sort of questions should i be asking ? i have read up on the the ACPO guidlines for this device & there are a few bits in there regarding reflective objects as down the read in question there is at least 1 speed limit sign every 50 meters or so & the officers having to turn off mobile phones & radios ect... how would i question whether or not all phones & radios were turrned off, surly it's the officers word against mine. |

Caught going away from the equipment AND shown the reading? Was the device brought to you from some distance away with a reading showing? Ask how the speed shown of -78 relates to your vehicle, where is a printout with time? a picture of some sort? The speed shown to you could have been there for half an hour and used as evidence for numerous drivers - if you think something is wrong ask what other speeds the police have for drivers caught before and after you. Surely that particular device must be brought into court and shown as evidence, with speed reading still there.

unless I'm missing something, how did they get in front of you? if you really were clocked at 78 going away from them, they must have travelled like the wind to get the gun into a position where you could be stopped with it, or did you turn around or were you driving in circles??

the road from start to finish is about a mile long, i don;t know where abouts they were on the raod but i have a good idea it was at the start of the road.
I was pulled over as i turrned off the road i was caught on They had brought the gun from the location they caught me at as it was in the T5 that i was stopped with, they must have traveled about 3/4 of a mile |

They pulled me over further up the road from behind (traffic T5) |

also the witness statememnt i got in the post from the officer was a pre printed template & he had just simply filled int he blanks, is this standard practice in these cases as i have been told by a reliable source that a templated witness statement shouldn't have been provided

what location was this then?
You say Met Police rural road? Met Police don't have many T5's these days they mainly use BMW and Vuaxhalls -------------------- "GET OFF OUR BACKS"

yup has all the usual tripe about being calobrated within the guidlines ect ect ect home ofice approval
Viper, was in the Hillingdon Area, looked like a T5 but it was dark, could have been a BM though, wasnlt really paying much attenetion just saw that it was the usual estate car |

Volvos in the MET? :lol i'm making it up ?? yer mate, i made the whole thing up for a laugh !! & i'm even going to court in under 2 weeks time for the crack too !!! WASTER !! As previosuly stated i "Thought" it was a T5, TBH it could have been anything, could have been a tractor for all i know, the last thing on my mind at that point was to enquire about the make & model of thier car, i generaly accosiate Traffic Cops driving round in T5 which is why i made the assumption, but i think the type of car they were driving at the time is pretty irrelevant to the case so it would be appriciated if you would stay on topic anyone else got anything constructive to add ? |

There were Volvo T5's in The Met years ago. I have not personally seen one for a few years. Only vehicles I am aware of are Vauxhall Omegas, BMW 5 Series, Vauxhall Montery and a couple of Land Rovers old style model
Anyone know any other marked cars used currently by traffic -------------------- "GET OFF OUR BACKS"

Insider has been at the Shiraz when he posted the pic of a 1994 Volvo.
They were given something like 8 of these by Volvo UK for testing. Handed back in 1997. Were talking this year, not the last century. Insider Dear, ask your 'partner' to lock the study door after 10pm, go to bed and watch the ceiling spin. |
