Fines for littering on private land.

Enforcement officers have recently been 'patrolling' outside the new Aldi in my area.

Then this sign went up on the Aldi entrance door.

And this is on the council website.

Now the very tiny PE signs in the car park informs us that it is private land, so surely they have no authority to issue fines do they?

One of the daytime progs the other day (Dom Littlewood thing) showed council litter enforcement occifers staking out MacDonald's and happily serving up FPNs in the car park when punters dropped litter out of the car window.
Must admit to thinking "can they do that?" but reckoned it is still public access so probably.
Duno if I am right but if anyone can explain it would satisfy my curiosity smile.gif

I had some oik bash my car in Tesco's car park and insisted as it was private land he wasn't liable nor had to give me his insurance details. A quick call to the BiB soon made him cough up the details...

The offence applies to any place in the open air unless the public don't have access.

Well that's answered that! Thank you all...

I also saw a daytime programme where the enforcement officer didn't know if a dog was pooping on public or private land.
He had to check to see if he could fine the owner.

But they are obviously covered by different laws I can now see.
