Hi guys,

Pretty annoyed about what transpired yesterday (Boxing Day). A package had to be picked up from a friend and due to car parks in the area looking visibly busy, the driver decided to stop in a garage private car park just opposite the car park where my friend had parked, literally to get out, go to him inside the car park and pick up a package off of him. The garage was of course shut being Boxing Day, and a few others cars were (I think?) short-term parked there.

Now as the driver parked up, he/she did see someone suspect (couldn't see any uniform/gear on him though) so thought they'd ask him if he knew the 'parking rules' there just to suss out if he was some sort of a warden. He very convincingly said he knew nothing and didn't live in the area.

So of course the driver left the car there and walked across the road into the car park to see the friend (car park is the one if you turn around 360 degrees from the GS shot provided below). Now, no more than 7-8 mins later as the driver got back to where he/she parked, he/she saw a device on this same guy and saw him having started at the driver's car end giving tickets!! Of course the driver straight up asked him why he had outrightly lied to him/her and could've just told him/her straight up. Obviously he was quite uncouth, started raising his voice, arguing, and used a couple of expletives, and when the driver said that it reflected badly on his comapny, he said "I don't give a s*** about the company, company don't give a s*** about me!"

Also, the driver couldn't see any signs near the bit that he/she entered this car park through (lowered kerb bit immediately at the center bottom of the GSV shot). It was only after getting the ticket, when he/she looked, there was a sign saying 'only patrons' and only during their working hours'. However this sign was on the right hand side of the office door and out of his/her view when he/she parked, and should've been more prominent!

Believe they're called Premier Parking Logistics, and it was outside Whittaker Fleet Care Ltd., Birmingham.

Anyone had experience with them, and a) Do PPL fines end up in court b) what grounds can the fine be appealed on (I mean is 7-8 minutes even reasonable time to fine someone in?)

Thanks, but for the purposes of the SAR I ask for any information they have relating to both the correct and incorrect spelling of my name (to make sure we get everything)?

And same goes for the CPR I should use the correct name from now on?

1. Copy of the Parking Charge Notice (PCN)
2. Copy of the Contract
3. Copy of the agreement between your client, Premier Parking Logistics, and the landowner/occupier giving them authority to act as they are.

In accordance with CPR 31.15© I undertake to be responsible for your reasonable copying costs incurred in complying with this CPR 31.14 request.

You should note that this claim has not yet been allocated to a specific track and the provisions of CPR 27(2) are of no effect. Had your claim not been issued through CCBC the Claimant would have been obliged to attach copies of the documentation upon which it relies to the Particulars of Claim.

I, as Defendant, am entitled to see the documents on which the Claimant relies and which you must produce at trial. Disclosure at this stage will enable me to fully plead my case and further the Overriding Objective.

You should ensure compliance with your CPR 31 duties and ensure that the document(s) I have requested are copied to and received by me within 7 days of receiving this letter.

If you require more time in which to comply with this request you must tell me in writing and confirm your agreement to an extension of the time allowed for me to file my defence as allowed under CPR 15.5 so I may notify the court.

In addition, I require you to take note of the following:
(a) I am seeking debt advice but I deny any debt and the case must be put 'on hold' for not less than 30 days under the PAP for debt claims.
(b) I have sent your client a SAR.

Quick question guys - received an email back from Premier Parking Logistics asking for more info to progress the SAR request (I had previously provided Name and DOB):

“To enable to complete the request of sending sensitive data, we need to confirm your identity. Please forward a copy of a form of identity, eg driving licence, a utility bill dated within the last 3 months to complete the request.

Please also forward the vehicle registration number the request relates to.”

I take it that its acceptable to send them copy of DL and they’re not just trying to get more info out of me?

They are obliged to ensure they are writing to the correct person so send a copy of your driving licence. It should not affect the 30 day time limit

Okay, will do. They claim “The period for responding to the request begins when we receive the additional information.” whatever that means..

They are trying to say the 30 days starts when they receive the additional info. I believe that is incorrect but I can't find the relevant regulation.

If you haven't got the V5C (logbook) for the vehicle involved (that should be sufficient on its own), I'd send them copies of two utility bills rather than a driving licence. Your DL not only has your full name, you date of birth and your photograph on it, but also your signature. I'm sure the Calais boys would be very pleased to have a copy of that!

So, just as an update (of what little there is), all I've received so far in terms of responses from either Gladstones or Premier Parking Logistics is a response to the SAR from Premier. This documents enclosed are basically just a redacted copy of the driver license I provided them for SAR ID purposes, the same pictures they took at PCN stage, and a copy of the NTK, all of which has been shared on here previously. I'll assume nothing is needed for now, please let me know if otherwise.
