Hi!

Im wondering if anybody could help me out.
I received a NIP in the post today asking for the details of the driver.

The offence on the letter mentioned running a red light - they have CCTV evidence.

I am guilty and have pleaded guilty.

It was stupid mistake on my behalf. It’s my first offence... what are the chances I will offered an awareness course?

Could I be done for careless/dangerous driving? It was a rail way/ level crossing... (yes I no stupid)

Thanks! 🙏

Strictly you haven't pleaded guilty...

However, a course may be offered if it wasn’t too far into red.

Who issued the NIP? (BTP?)

What offences are listed on the NIP?

--------------------
RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution
PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request

Private Parking - remember, they just want your money and will say almost anything to get it.

If im being honest I think the lights were flashing red for a while.. 2-3 seconds after I crossed the barriers started to slowly come down. It was just a Sh*t day in general and I was in a rush (no excuse) like
I have said I have sent them my details.....

Yes the letter was from the BTP. It was asking for my details and it mentioned going through a red light plus the time and place. (Section 36 Traffic Offence - Failure to comply with traffic signs)

I just don’t want to get banned/ get 9 points ( Job involves driving, I could lose my job..)

Course or 3 points and fine would be ideal.

A s.36 offence brings 3 points, either as a fixed penalty or in court.

I got a feeling the lights were flashing red for too long for me to get offered the course but then that makes me think they might do me for careless driving. I can take 6 points max or I’ll lose my
Job.

Would I have got the offence for careless driving on the NIP I sent back or will I receive that separately?

I don't believe there is a course for ignoring road signs. Maybe 3 points and a hefty fine. Think yourself lucky you are still alive to tell the tale. Trains usually win when thy hit cars.

There is for traffic signal offences, if qualifying.

My gut feeling says I will not qualify for the course as the second set of Barriers started to close seconds after I went through..

Which in all fairness i probably don’t deserve it anyway but at the same time it’s the first time I
Have ever done something stupid in 7 years of driving I’ve not even had a single parking ticket I would be absolutely
Gutted to get over 6 points/ a ban.

Should I hear from them soon if they was to be doing me for careless driving aswell? If I was
To get charged with careless driving (3-9 points) could I try argue my case to get only 3 points from
Each offence + A hefty fine. That way I can carry on with my life (Job) but have to enjoy increased premiums for the next 3-5 years...

If only a s36 is mentioned then you are only looking at a 3 pointer.

I hope so! I’ll post an update when I hear something, hopefully soon.
