Old addresses, parking tickets and CCJ's...oh my!

Hello all,

I have recently been notified of a CCJ on my credit report. I had an excellent credit rating and it has now dropped off the edge of a cliff!

I investigated further and found it’s come from the Northampton County Court Business Centre. I called them and they told me the debtor is a company called Civil Enforcement Ltd, which is a private car park company.

The NCCBC then sent me a case form, which details a ticket I incurred on the 30th November. However, I changed address earlier that year in June, so the notifications will have been going to my old address. I didn't get around to changing my address with the DVLA January 2017.

I have learned of all this over the 28 day threshold, so the CCJ is on my credit report.

They told me I have one of two options. The first is to settle the fine and keep the CCJ on my report for 6 years. The second is to pay the fee to contest and have the CCJ set aside.

I'm decided to contest, as I feel that this is unfair and I would have paid the fine, had I had prior knowledge.

Do I stand a chance?
Does anyone have any successful defence formats I can follow to successfully defend myself?

Complete a N244, attach a Witness Statement and a copy of the defence you would have/wish to have heard in the event of a hearing. From the threads I have linked there, you should have enough to see what's needed and show us your draft. You do need to explain in detail why you were unable to defend but that you were 'there to be found' having moved address. I also favour the WS that mention the Government's position from Sir Oliver Heald, you will see them.
