My view entirely, this case seems to have more to it than meets the eye. the insurance certificate will have a "valid from" time on it, usually 00.01 on 31.02.2024 for a period of 24 hours. I doubt it would be valid from 17.45 on the dot which the op says is when he received it. Hourly insurance apparently. |

Further, someone uncharitable might think that you intend to lie about who was driving (or that you cannot remember). That would be most unwise. |

Purely anecdotally, when I completed accident reports I tended to tick the box that said speed was a cause of I thought a slower speed might have avoided the accident (obviously avoiding the absurdity that a stationary vehicle generally won’t cause an accident). The statistics are probably rubbish. |

In the event the evidence is just what the officer saw or observed, how likely is a conviction? At this point, is it not his word against mine? Convictions happen on that basis all the time. To think that the court can’t be sure of guilt when there are conflicting statements is a fallacy. The court can simply not believe one of the witnesses. |

Let’s not forget that if insurance wasn’t in place at the time alleged by the prosecution, a subsequent decision by the insurance company that it would have met any claim doesn’t provide a defence. On that basis, the position may well be the same where the FOS orders the insurer to insure. That is, of course, a separate point to whether a prosecution remains in the public interest. |

As regards criminal damage - the key term is "without lawful excuse". If you are parked lawfully and the only way to protect your right to use your car is to damage a car that has blocked you in, that would be the lawful excuse. As regards any civil claim, volenti non fit injuria. I can see the argument. I’m not convinced it’s correct. |

If she is parked legally, and is subsequently blocked in, she is entitled to use her car, but must take all reasonable steps not do cause any more damage to the car(s) blocking her in than is reasonably necessary in order to get her car out. I can never tell when you’re being sarcastic. |

Strictly, there is nothing to appeal. If you decline the course, the police will probably prosecute you. If convicted of careless driving, you will get 3-9 points. |

In one respect, that’s why I’m glad we’re a small bar and are thus all ‘generalists’ to some degree. Juniors often get plonked into the magistrates to get some experience, so most have done some criminal advocacy at some point in their career. |
