Hi guys advice needed, I got 2 PCN's for Hackney for the Mare Street timed left turn like this thread
http://forums.pepipoo.com/index.php?showtopic=122055 my situation is that I have a leased car, I contacted my lease company after receiving admin charges for PCN's, they said first PCN Date of contravention: 21/06/18 Date of notice: 19/07/18 Lease company received: 23/07/18 Second PCN Date of contravention: 22/06/18 Date of notice: 19/07/18 Lease company received: 23/07/18 I received admin charge letters from lease company 10/08/17 Does the 28 day rule apply here too? Can I challenge now or wait till Hackney send me the new adjusted PCNs then challenge. Thanks in advance. |

My apologies for the confusion? I got your case mixed up with somebody else.
The lease company received two PCNs? One for a contravention on the 21st Jun. The other for a contravention on the 22nd June? They used their statutory defence and transferred liability to you? You have received a new PCN addressed to you at your address dated 11th Sep. This in respect of the contravention on the 22nd June? A fresh PCN for the 21st June contravention has never been delivered to you? You tried to submit representation against the PCN you actually received and it appears to have been closed by the Council? So are you sure you've used the PCN number on the PCN you received? Is it the same number as used on the corresponding PCN sent to the lease company? Do you have the envelope for your PCN? What's the date of the postmark? |

Yes the PCN number for 22/06/18 I received at my home address is the same number as the one issued to the lease company. Also checked the PCN number dated for 21/06/18 I got from lease company, also showed same message as 22/06/18 PCN as "Your PCN is now closed, Thank you" dont have envelope anymore. If both PCN are cancelled by council does that mean I'm in the clear? |

Well now! This is becoming "another fine mess".
Leaving aside for a moment the apparent late service of the original PCNs on the lease company. AIUI the fresh PCNs issued to you at your address should have had fresh unique reference numbers. It doesn't pass my credibility test that the would have sent a fresh PCN for the second contravention and not for the first. So it seems that one PCN has now gone missing. It seems likely that both of the new PCNs re-used the original numbers. The PCN status system sees these PCN numbers as cancelled and presumably so does the payment system. Because the system sees the PCNs as cancelled you can't submit representations online or pay. I'm not sure what to do about this? Or whether you need to do anything at all? It's a situation that's not supposed to happen. In the case of the PCN you don't have you could presumably wait for a Charge Cert followed by an Order for Recovery and then submit a Statutory Declaration. However what to do about the PCN you do have? Perhaps submit representations by post or maybe do nothing and see what happens. See if anybody else has any ideas. I think it is essential that the OP get something to the Council to protect himself and create an "audit trail".
If the Council have cancelled the PCNs such an exercise is obviously going to be fruitless but it is good insurance against further action from them. Doesn't have to be a huge appeal just a synopsis of the issues/events with the tag line that the PCNs should therefore remain cancelled. --Original PCNs served out of time; --Reissued PCNs therefore illegal; --Original PCNs were cancelled but the reissued ones bear the same numbers; --Not able to pay or appeal on the Council's website because of this glitch; --Contravention given is in any event compromised; --There is an issue of vague locus on the PCNs; --Understand Council have cancelled both re-issued PCNs.
