I previously posted on here after receiving a LBCC. I follwed advice stating frustration of contract and still they came back at me intending to take me to court unless i paid. Despite protesting my case twice now i have today received a letter from Northampton of court action. Again i can state my defence. Their statement states the usual particulars about notices and failure to pay and mentions that i did not use POPLA to appeal. Now this strikes me as odd in the sense that they had already refused my original appeal so why would me choosing to not appeal to POPLA matter? However would the court see that as a reason to uphold their claim? Is it worth me stating my defence or should i admit defeat at this point? Charges now stand at £175. Could they get more if they rule in their favour?

I believe i have a good case. I had every intention of paying but I had no loose change and there was no card paying facility. That coupled with an extremely poor phone signal meant that i struggled to play using text and phone and app. I had no choice but to leave after 20 minutes of trying to pay as i could not pay. What was i supposed to do? I was advised to use frustration of contract..but they seem to have ignored this.

Any help and advice on my course of action wouldf be appreciated.

I assume this is a continuation of your previous thread? The forum's rules are 1 thread per case, so please repost the above on the existing thread, or ask a mod to merge them.
PS - don't under any circumstances submit a defence before its been discussed on this forum. And note that you are now working to strict court deadlines where if you're late you automatically lose.

So why didnt you appeal to POPLA?
Of course PE dont care what you said. They dont get paid if they accept appeals. They are corrupt by definition.

If you have a court claim form, then
1) Tell us the ISSUE DATE
2) Go ONLINE using the instructions ON THE FORM and ACKNOWLEDGE the defnece. Use the MSE FORUM -> Parking sub forum -> NEWBIES thread -> post 2 to guide you through this part and ALL parts of the whole process

Fail to meet deadlines ,you lose.

They can claim another £25 on top of £172 IF they win. You have a good defence.

Again: they dont get paid unless you pay them. So they reject ALL appeals.

Thanks for the help. I will do as advised.
I appealed to Parkingeye...rejected and then i was given advice to just ignore them. Bad advice as it turned out. This was before i came here unfortunately.

The issue date is the 11th of November.

I have asked for the threads to be merged. I apologise.
