Hi there,

A friend of mine got a ticket by cctv in the post for stopping on the red route on a Sunday evening after 9pm.
He was feeling some chest pain so quickly stopped to rest for a 2 minute and did not realise the red line.
After getting the ticket he asked for cctv and after receiving it he tried making a representation on TfL website but was not given him options to do so. He then tried calling but always busy and he sent them an email to say he is having this problem. He had not received a reply to the email and on 3 days ago he received a charge certificate he asked why he got it and explained the problem he was having they now asked him to do a late representation by post.

Is there anything that can be done to make a good representation any advice will be helpful

How did he send the representation, and on what date exactly? Also show us the letter that came with the CCTV footage.

He requested for evidence and cctv footage on 07/04/19 using TfL online website.
He received photos and cctv evidence on different dates and he tried making representation online on 01/05/19 then sent email on 02/05/19 saying can’t make representation online.

In their letter of 19 April, TFL say you must send a representation together with any evidence you want them to consider within 14 days, i.e. by 3rd May, they cannot resile from that. Let's see the email they sent back on 2nd May.

Please tell us more about the "chest pain". It would be natural to stop in such circumstances, but such is the greed for cash by councils they will only give way if some form of medical report is presented.

They did not send him any email.
The chest pain he gets now and again there is no pattern He can get it any time He has been to AnE few times and his GP and they done some test but found nothing so there is history and He can get a medical report from GP.

So why did you say he got an email on 2nd May saying he couldn't appeal? Just cos you've edited it out of your post doesn't change anything so just tell us.

Either way, IMO if he made reps within the deadline as extended by TFL, and no Notice of Rejection has been served, the statutory ground for a witness statement is made out so that's the route forwards.

I wrote the post as I and not him so I edited the post.

I wrote that “he tried making representation online on 01/05/19 then sent email on 02/05/19 saying can’t make representation online.”

I hope that helps clarify things.

Getting little "angina attacks" like your friend got are fairly common in the adult population as I understand it. Has he been subscribed any medicine ? Is he morbidly obese ? Normal stuff is something that goes under the tongue, I believe it is nitroglycerine of all things !! If your friend wants to fight it, he will need to get a doctor's letter.
