After Reading various posts about Speeding over the limit I found this at The South Yorkshire Road Safety Partnership which I hope will be found useful


What is a speed awareness course and why have I been offered the opportunity to attend?
The speed awareness course is an educational presentation that lasts approximately four hours. The workshop takes place in a classroom based scenario with up to 23 other motorists. The speed awareness course does not involve any type of test.

You have been offered the opportunity to attend a speed awareness course because you were recorded driving above the legal speed limit. Although we do have the power to prosecute those who break the speed limit, we would rather persuade drivers to slow down. We would prefer you to change your driving behaviour in relation to speed before you become subject to a prosecution or consequences for yourself, or others, which may be even more dire. Speed awareness courses are offered for offences committed at the lower end of the enforcement bandwidth in order to influence driver attitude and behaviour.

Am I eligible for a Speed Awareness or "Whats Driving Us" course?

A place on a Driver Behaviour Course may be offered to those who have committed lower level speeding offences (see thresholds below) or some other minor traffic offences, as an alternative to receiving a conditional offer / fixed penalty. High speed offences and drivers who have already completed a Speed Awareness Course or "What Driving Us" course in the last 3 years, will not be eligible to take another course of the same kind. A driver cannot request to attend a Driver Behavour Course.

Those are the national guidelines, action taken at 10% over limit plus 2 mph, courses offered up to 10% over limit plus 9 mph.

Interesting.

Are these definitely NATIONAL guidelines? Presumably, Guidelines not being law, no UK Force is obliged to accept them or apply them fairly in every case? They could set higher or lower margins. Google couldn't find me any mention of this +9mph anywhere, not even Yorkshire

I have a NIP for 62mph in a temporary 50mph zone on M23 motorway roadworks. (No works or workers in that stretch, they were further up)

It was in clear dry weather, sunny day. Traffic volume was light and it was just after a 70mph stretch. (will that be taken into consideration?)

50 x10% = 55mph + 9Mph = 64mph, so have I just squeaked in under by 2mph?

Am I likely to get a SAC in Surrey? (No prior convictions, pendings, or points)

They are guidelines, no police force has to follow them, nor are they obliged to as courses are not covered by statute (and there is an argument they fall foul of the fraud act).

That said Police forces do have an obligation to act fairly so while a force could choose a different criteria they should then apply it fairly within that force area. So no difference if you are from an ethnic background (or appear to be), are married to the chief countables daughter or know a range of funny handshakes.
