CitiPark and Bay Sentry Ducie St Manchester

Hi all,


So i parked in a CitiPark car park next to a hotel and to pay there are no machine but you are asked to pay on the CitiPark app that they have on the signage. The default amount is £4 up to 2 hours. I arrived at 3pm and exited at 530pm. I did setup and install the app which will be clear as when you setup your app and enter your reg and select the car park on the app it takes you through a default payment of £4.00 which cannot be adjusted to your preferred stay. I did check this on the app after payment. It went through but is a very basic app. So today ive got the notice to keeper and reminder which ive only just received in the post. Asking me for £100. So i have the invoice from the payment of the app, and have emailed the Bay Sentry appeals to describe that due to the app being insufficient and not clear you cannot change the amount you want to stay for or is not shown on the app.

Since then i enquired to Citipark about the lack of clear instructions in the car park to pay and when to pay. They have since sent me this. Is it worth taking photos any signage to support my case on this below statement.

As per the notices in the car park, you pay at the end of your stay.

The camera picks you up as you enter and then when you are leaving, you log on to the app and it calculates how long you have been in the car park and charges accordingly.

If you attempt to pay at the start, it can only charge you the minimum amount of £4

You are then unable to pay any further as it assumes you are paying for your parking and does not want to duplicate the payment

If you have received a notice, you will be requires to contact the company that has issued this via their website and appeal it.

Since this has happened ive had the NTK and Reminder and i have appealed directly through Bay Sentry appeals was just looking for some general guidance.

Bay sentry are enforcing the parking

The app is clearly a third party app for making payment

W separate contracts

It is the drivers responsibility to read and follow any signage on the site , so I suspect that citipark are correct and the driver failed to correctly comply with the terms

Any appeal goes to bay sentry, not citipark

You don't appear to have linked any pictures of the PCN nfk ( suitably redacted ) nor any pictures of any signs onsite either ( so haven't read the important topics at the top of this forum before posting )
