I was clocked doing 82mph in a 60mph on my way to Newquay on the Ilminster bypass back in April. Must confess I thought it was 70mph, but I doubt that cuts any ice in this situation.
I remember seeing the mobile camera too late, and had been overtaking a particularly slow driving person in front on one of the dual lane sections at the time. Bang to rights, annoying way to start a family holiday. I got the 3 points and £100 fine in the post and then a reminder before I then sent back guilty, paid the fine and forgot about it. I've now had an SJPN through on two counts, 1) for failing to provide evidence and 2) exceeding speed limit. The courts in Bath, I live in Essex so that's a 3hour drive to appear in court on the day. Consulted a speed lawyer for free advice, and he's suggested pleading guilty to the speeding and writing a letter outlining the fact I paid the fine and sent off the paperwork. Is there a template letter I should follow in this regard, or has anyone had any experience in relation to this scenario? The fine as I understand it will be the best part of a weeks wages, which is really going to hurt. My finances are a bit of a mess, will they give a lower fine if you can prove you've got financial issues? It's looking like I've gone from what I thought was 3 points and £100, to 6-12 and a hefty fine, and other than the original speeding I don't really see what I've done wrong here so it's really frustrating that there seems to be no way of resolving this now. Help very much appreciated |

Yes, thats exactly it - this "deal" is found in many threads, so you can see how it SHOULD go. There is no mitigation here. You are not saying "im guilty, here is why that isnt as bad as normal" youre saying - I'm not guilty, and here is why.... Failing to change your plea sounds like a good way to ONLY have FtF in play, and whats your defence to that going to be? I would personally change it. Thanks I will email and change my plea then. Sorry I'm looking but I can't see a thread that sets this deal strategy out? Do you mind posting a link? Thanks |

Try searching - there isnt a single thread to go to, rather MULTIPLE threads where FtF AND speeding have been charged
Youwould also ask to be sentenced at the fixed penalty equivalent as any failure to take the offer up - the one in the superNIP/S172/CoFP - was for reasons uncoonnected to the offence. |

Thanks have found a couple of threads now. The search bar throws up websites to start with which is slightly confusing.
Fingers crossed I haven't made it harder for myself by submitting and then changing my plea. |

Also - youre jumping the gun somewhat here.
You get a response and act, without seeing the balance of responses or checking. Im just one person. The point of a forum is MANY EYES. You had lots of time to wait before submitting a change of plea. so after the first time wher you jumped in with both feet, pausing and not reacting in haste would have seemed prudent! Search bottom left, not top right. I don't understand what you're suggesting there - the bottom left search box is for keywords within this thread only. The top right one is a Google search, but restricted to Pepipoo only. -------------------- Regards,

Top right should indeed only look through pepipoo, is that he issue youre facing OP? It lists websites OTHER than here? |

I'd sat on the paperwork until the last minute was the reason for my haste, so I had to submit something so just went ahead and did what I thought was best. The search bar gives you some website links before it gives you internal links is all. |

Hi all
Thanks for previous advice. Got my court date through but I had to ask for an adjournment as it randomly clashed with another court date (this one I'm not on the wrong end of) and the woman on the phone said that I can ask for the hearing to be moved to a local court. So I am currently waiting for a new date to come through. I'd much prefer this given Bath court where it's slated to go to is a 6 hour round trip by car and 9 by PT. Would anyone know if requesting it to be heard at a local court affect my intention of pleading guilty on the day, and getting the FTI dropped? Thanks in advance |

The issue is that they will normally only transfer it for a sentencing hearing once the guilty plea is entered (for obvious reasons). That might be so where "live" witnesses may be required but few speeding offences that are detected by remote device or S172 offences need that. Of course the court might argue that until the bases of your NG pleas are known it cannot be certain that no live witnesses will be required. You cannot plead guilty to speeding and NG to S172 because, as pointed out earlier, you risk nine points. You obviously cannot plead guilty to both for that is a certain nine points. I think you can only make your request for a transfer to the original court and see what happens. At the very worst you will have to make the trip but that must be infinitely preferable to having to defend the S172 charge. |
