Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - Second
If your are not the Registered Keeper, what is your relationship to the vehicle? -
How many current points do you have? - 0
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - nip is for speeding, first I know of it is reminder letter dated 29/9/17
For offence 17/8/17 date on enclosed NIP is 29/9/17.
Could be me or wife as both use car but time seems out with either of us travelling that way.

If you could prove that you never received the original NIP you would have a defence, but of course it is very difficult to prove a negative. The police will be able to prove they posted the original and it is assumed delivered unless you can prove otherwise. Unless you name a single driver the police are likely to prosecute you for that offence; realistically could anyone else have been driving the car? The postage is probably at the discounted bulk first class rate but only matters for the first NIP.

You do not mention the speed and limit, but unless this was grossly excessive, your most pragmatic move is to name the most likely driver out of you and your wife. 42 or under in a 30 limit should get the offer of a course if the driver is eligible, up to 50 a fixed penalty.
