Hi,

I am the black Nissan Juke. I was planning on going in the left lane and the jaguar came out blocking both lanes so i was stuck in the yellow box junction and have a fine.

Is there any case to appeal this?

well you weren't in the box when the Jag was, but at traffic speeds there is a case and you can have a go.

There's a known flaw on Redbridge moving traffic PCNs, so I recommend you post it up so we can double check.

Perhaps other members might like to comment on the fact that part of Redbridge Lane East is not within the civil enforcement area.

42 here:- http://www.legislation.gov.uk/uksi/1994/1509/schedule/made

I know the PCN is under the 2003 Act and the above legislation centres on parking but I would have thought that a civil penalty would have to occur within a recognised CEA.

I notice that there is prospective legislation allowing London Councils (by Resolution) to define their area ----so, is there wriggle room (vague location) ?

I don't think so, they're different schemes. Powers under the 2003 Act apply to all roads within a borough (except TFL roads, unless the borough has consent from TFL to enforce on their behalf).

hornet90, have a read of Robert Atlas v London Borough of Barnet (case reference 2170053479) on https://londontribunals.org.uk (you'll have to look it up by case reference), your PCN has the same flaw.
