Nottingham Bus Lane appeal success !, Carrington Street

As I've now discovered, Nottingham bus lanes are notorious, 170 fines splurged out by the council every day. Carrington Street is one of the worst, I was concentrating hard trying to work out if it was a bus lane or not and I saw cars ahead of me going up there, it was raining and as will be seen on the pics the road markings were poor. Basically despite driving a lot of miles a year, I thought all bus lanes were painted carriageways.

My appeal to the council was turned down, I then appealed to the tribunal using google street view images on the basis:
1) the road painting is faded and suggests the bus lane is pointing up the left hand lane only, outside the station where the bus stops are. The penalty notice camera pic is of me in the outside lane overtaking a bus in the bus stop. I can't see on street view where I would have crossed a white line designating the start of a bus lane.
2) before the bus lane there are goods vehicle parking slots so that any vehicles parked there will obscure any blue roadside signs
3) that so many drivers were being caught on this road that by definition (there's a quote by Simon Williams of the RAC somewhere) the signage must be inadequate
4) that a week after the alleged offence the transport secretary supposedly sent out guidance to councils that first time bus lane offences should be handled with warning letters not fines.

As the council didn't reply to my submissions I can only speculate that points 1) and 2) were probably more relevant to winning my case. Anyway one more small victory against petty tyranny lol.

Carrington street isn't a bus lane as such.It's a road for buses,taxis,cycles,delivery vehicles, access, and R8 & R9 holders.There are blue signs at each end of the road stating this, and any offenders who do not fall into the categories will receive a £70.00 fine in the post.There are also infra red cctv cameras to catch offenders 24/7.
Regardless of all this,I am glad you won at appeal.I did the same a few years ago using a bus lane on Canal street.As I drive buses in Nottingham,i know the area pretty well,especially Carrington street.

Hi I’ve just walked in my front door to find a letter saying I too was in a bus lane on Carrington Street in nottingham, it was my first visit to Nottingham and followed my google maps app which sent me down this road, should I just pay or appeal as obviously I was on the road but wasn’t aware it was

I would say definitely, just use my arguments above, the signage and road marking is inadequate etc
