PCN from Euro Car Parks

Good afternoon everyone,

Firstly I’d like to thank everyone who have taken the time to read my post and it is much appreciated.

I received a letter in the post from Euro Car Parks today 25/March/2019 stating:-

“On the (date) you were the registered keeper of the vehicle (registration) or you have been named by the registered keeper as the driver/hirer at the time of a breach of terms and conditions of parking.

We are using cameras to capture images of vehicles entering and leaving the car park to calculate their length of stay. The signage, which is clearly displayed at the entrance to and throughout the car park states that this is private land, the car park is managed by Euro Car Parks and sets out the terms and conditions of the car park by which those who park In the car park agree to be bound. The Parking Charge Notice (reference number) has been issued as the vehicle was in breach of the following terms and conditions;

No Valid pay and display/permit was purchased

The vehicle was parked at (name of pub and address), by remaining at the car park without authorisation, in accordance with the terms and conditions set out in the signage, the Parking Charge in now payable to Euro Car Parks (as the creditor)

You are notified under the paragraph 9(2)(b) of schedule 4 of the Protection of Freedoms Act 2012 that the driver of the motor vehicle is required to pay this parking charge in full. As we do not know the driver’s name or current postal address, if you were not the driver at the time, you should tell us the name and current postal address of the drive and pass this notice to them.

You are advised that if, after 29 days from the date given (which is presumed to be the second working day after the Date issued), the parking charge has not been paid in full and we do not know both the name and current address of the drive, we have the right to recover any unpaid part of the parking charge from you. This notice is given to you under Paragraph 9(2)(f) of schedule 4 of the Protection of Freedoms Act 2012 and is subject to our complying with the applicable conditions under Schedule 4 of the Act.

Should you provide an incorrect address for service or identify someone who denies they were the driver, we may pursue you for any Parking Charge amount that remains unpaid.

If you are a vehicle-hire firm and the vehicle was hired out at the time the parking took place, please let us know and provide us with a copy of the hire agreement and a copy of a statement of liability signed by the hirer under that hire agreement. Please not that we may have a right to recover unpaid parking charged from you.”


They also included a picture of my number plate and underneath the pictures was date and time of entering the car park and leaving the car park.

I am the registered keeper of the vehicle however I was not using the car on the date which the infraction occurred. It was one of several people who are insured on the vehicle and use it regularly.

Any help and advice would be greatly appreciated.

So what are the dates on the PCN?

Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give the invitation to the keeper required by section 9 (2) (e) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

I was not driving at the time and as there is no legal requirement to name the driver at the time and I will not be doing so.

Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

Can you show that you were elsewhere at the time?

So the dates are of no help.. Send that letter I suggested.
