Hello,
PCN has been received from the parking company on behalf of the shop who has cameras installed outside his shop. The driver went to buy something and did not like the product and left the shop (visit time 10 mins). The owner of the shop contacted and he says the driver never visited. Please find the photos of pcn. Any help would be appreciated. Thanks https://ibb.co/GWycdZR https://ibb.co/Snw3LXM https://ibb.co/c8vJK6t |

Clearly a render, not in situ
I'd grab photos showing this signs in their context as well, ie that they are def the same area |

I literally just told you. Your photos do NOT show it's the material carpark.
You could appeal to the ias, but you WILL lose. So I wouldn't bother. At that point you sit and wait for a letter befor claim or a claim form. |

Hi, I have received a solicitor letter please see below:
Any help will be appreciated Private and Confidential 23/07/2022 Dear, Car Park Operator: PARKING AWARENESS SERVICES QDR Reference: Parking Charge Notice PCN) Number: Vehicle Registration Mark: Location: KUBUS POLISH SHOP TW134EZ FELTHAM TW134EZ Issue Date: 12/02/2022 Parking Event: NOT AN AUTHORISED VEHICLE AS DETAILED ON SIGNAGE. Outstanding Balance: £170.00 We have been instructed by ZZPS Limited who are acting on behalf of PARKING AWARENESS SERVICES in connection with the recovery of the debt, which has been incurred following the failure to repay the Parking Charge Notice, and we require youto make payment in full within the next 14 days. Failure to make payment in full or contact us to discuss repayment of this debt may result in us recommending to our client that we pass this matter over to our Litigation Department. This may mean they will look to obtain a County Court Judgment (CCJ). The possible impacts of having a CCJ registered against you are: Negatively impact your credit rating Prevent future lending Affect current employment or future prospects of employment Enables enforcement action to commence, such as obtaining an Attachment of Earnings, placing a Charge on your property orapplying for a Warrant of Execution (instructing a bailiff). Please call us on 01926 758736 to make payment by debit card or via our Automated Card Payment System, this is the simplest and quickest method of payment or alternatively please send a cheque to the above address, quoting our reference number. Please note that free independent advice and assistance can be obtained from the free independent advice organisations on the reverse of this letter. We hope to resolve this matter without the need of reviewing your outstanding liability; therefore we look forward to hearing from you. Yours sincerely, |

That is a debt collector , not a solicitors letter, it gave 14 days notice, not 30 daysnotice, no financial forms either, so not an LBC and not a solicitors letter, because zzps are nit the claimant and never were
Come back here if you receive a true formal LBC with 30 days notice plus financial forms, where zzps won't be mentioned |

Thank you Redx.
Understood, however, received an email from Solicitors and found the letter when logged in by inserting the details. Can they obtain a CCJ without going to the court? |

Standard practice in these matter, an LBC from QDR solicitors acting for zzps, acting for the claimant parking company Parking Awareness
Treat this like an LBC and reply with the usual typical replies to an LBC, alleged debt denied, refer back to the client, telling them to put the matter on hold for 30 days whilst you seek debt management advice etc, so similar to any other LBC Also email a SAR to the DPO at the claimant parking company Parking Awareness, attaching redacted copies of the 2 recent utility bills as proof of I D under the GDPR law to obtain all your data, if not done already Then it's await any replies or responses, but assume that you will receive ia court claim pack from the CCBC in Northampton using MCOL at some point this year, so study this thread over on mse parking forum in announcements https://forums.moneysavingexpert.com/discus...-first-thankyou |

Redx - also start asking people to request documents at this stage in the lbc response. They have to give a reason why they ccannot be supplied, and it stalks the clock beyond 30 days in most cases. It also takes them more effort so likely to be out in the too hard pile.

Thank you!
Sorry, I have few questions: So firstly, write a letter to QDR stating that I do not own this debt and ask them 30 days grace period whilst I am looking for debt advise? Sorry I am little confused. What is the full form of SAR and DPO please. If this just an invoice, why do I have to send 2 forms of identification. I have to ask the QDR for the documents? If so, what sort of documents please. SAR = Subject Access Request (example here: https://legalbeagles.info/library/guides_an...access-request/)
DPO = Data Protection Officer, the person at the parking company to whom you should send your SAR. For Parking Awareness Services this is data@parkingawareness.co.uk, according to their website The reason for sending two forms of identification is so that they process your Subject Access Request - they need to confirm your identity to make sure they're sending your personal data to the right person. As an aside, the Imgbb links you added to your original post no longer work. It may be worth updating these in case they're needed for future advice on your case. -------------------- Useful Links (for private parking charges):

Thank DWMB2 - Can I write to the solicitor that I do not believe that I am liable for any contravention and that I have proof (one of the signs say different to what the parking company claims and has sent as proof) and can be presented Infront of the judge? In this case, is there any requirement that I need to provide the proof to the solicitors and solicitors may think that do not have a strong case and might not proceed further.

'Owe' debt, not 'own' the debt! and Yes, that's what you tell them. Subject Access Request and Data Protection officer, both detailed on the ICO website. So they know they are sending your data to you! You ask for ALL, no need to be specific! -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!
