Hello,
I got a ticket by post saying I turned right when it was not allowed to, I can’t remember seeing a sign saying I can’t turn right. I went on to the council website and saw the photos that they hold one photo showing a big lorry blocking my view so that would be the reason why I don’t remember see it the sign also I can’t see the cctv footage on the website and one photo is missing. I have attached all photos and the PCN. It there any way I can appeal and win this. Thanks. |

We've seen this one a few times - don't think there's any hope on signage and Tower Hamlets PCNs are robust I think.
However, as you say there is a truck moving past the sign on the other side of main road - PM me the details and I'll see if I can get video. Otherwise you'll need to ask for it. https://www.google.com/maps/@51.5268189,-0....6384!8i8192 This post has been edited by stamfordman: Sat, 20 Jul 2019 - 20:20 |

I've checked on various systems/browsers and there seems to be a video but I can't get it to load. You'll need to contact TH to get it.

There was a NRT sign before you reach the give way line as well, is it still there?

There was a NRT sign before you reach the give way line as well, is it still there? I'm sure it is as per the GSV - I'll be down there during the week and can check. But it's reasonable to expect confirmation with road markings (none here) and another sign (possibly obscured) once you reach the junction itself. I also think there should be a sign at the junction on the same side of the road. This post has been edited by stamfordman: Sun, 21 Jul 2019 - 20:04 |

If you send me the PCN details I can try and pull the video directly off the TH server. -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php

The TH website seems to be broken at the moment, you'll have to contact them and ask for the video.

OK BQ you're going to have to tell us how you did that.
As for the video, it looks encouraging to me - sign opposite obscured as OP draws up to stop. The advance sign is not enough in my view. This post has been edited by stamfordman: Tue, 23 Jul 2019 - 20:09 |

It does seem odd that there's no sign at the junction itself, which would be the normal layout for this sort of restriction.

I would also have expected a white arrow pointing to the left in the road.
I know that junction well - I used to use that route by motorcycle regularly. As it happens left was the direction I wanted to turn anyway. But the restriction looked clear to me at the time. This post has been edited by Earl Purple: Tue, 23 Jul 2019 - 10:57 |

You can't appeal yet, first you must make a representation to the council. If that representation is rejected, only then you can appeal to the tribunal.
If you want to challenge it, just draft a representation on the basis that the sign was obscured by the truck, and by the time you started moving and the sign came back into view, you were focusing on traffic / pedestrians etc. Put a draft on here for review before sending it to the council. -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php

Hi please see my draft representation.
Thanks Dear sir or madam, I wish to challenge the PCN that was sent by post. I have seen the photos uploaded on your website and as far as I can remember I did not see any sign saying I can’t turn right. I can see from the photos on your website that a truck was blocking the sign and I was concentrating on moving vehicles and pedestrians and did not see any sign at the end of wilmot st E2 as I was approaching the end of the street. I would appreciate it if you consider my representation as cancel this PCN. Thank you |

They'll probably reject but there's not much you can add.

Do you think I’ll have any chance with the appeal if they reject the representation.
Can I raise the point that no sign is on either side of the road that I’m approaching. And are they not meant to give 21 days to pay at the discounted rate or have read that wrong somewhere. Thanks |

And are they not meant to give 21 days to pay at the discounted rate or have read that wrong somewhere. Thanks 14 days is the correct period for this type of penalty. There's a sign here https://www.google.com/maps/@51.5268189,-0....6384!8i8192 but you can make the point that there's no sign at the junction itself. If they reject we'll need to see what they say before we can tell you whether it's worth appealing, you never know if you're lucky they might mess up the response. -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php
