Hi,
The council have told us to keep refuse bins inside our property within the boundary of our property. However on the land registry our property extends outside of our wall and the small back street pavement. I understand we would need to passage for others but there is ample room to pass through the back street. What’s your take on that guys? |

That is a question you should address to your local Authority (Refuse Dept).
Bin collectors can no longer access Private property, for fear of Trespass and the lorries stick to the nearest highway for route. Our road contains 10 terraces, bins for each kept at back, but each week the residents are required to place their rel bins on the pavement in front of their house on correct collection day, for a max 24 hours. |

There may also be restrictive covenants mentioned in the title which prevent leaving bins, or other items, in specific places (like the pavement outside the wall at the back)

It’s the case here, we put the bins out which isn’t an issue. Happy to carry on doing this. And the lorries have access to where it’s left. The issue s once they are done with them. Then we have to take them inside already tight back yards. We should be able to leave them on the pavement. Which is technically within the boundary of my property There may also be restrictive covenants mentioned in the title which prevent leaving bins, or other items, in specific places (like the pavement outside the wall at the back) I don’t think it is mentioned. As the bin rule is relatively new. And might even be a policy that they are trying to enforce. |

If it’s on the pavement then it can be an obstruction of the highway (and it’s irrelevant if you own that bit of highway).

Bin collectors can no longer access Private property, for fear of Trespass They have an implied right of access to the bins on display in front of them! All the bins on our road are left on private property and emptied. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!
