Hi Guys,
The Driver used the facilities and purchased goods in the service station. The keeper received the letter and is now dealing with the issue. Where does the keeper stand with this. The driver was there for less than an hour. Regards, Jinxy This post has been edited by Jinxy: Thu, 24 Sep 2020 - 17:44 |

Hi Folks,
The keeper received this from a debt recovery agency. For reasons that can't be put on here the POPLA appeal was started but not completed. There are the usual ''If's'' and ''may's'' in the letter received by the keeper. Any advice on what the keepers next step should be? Should they take the wait and see approach? Does this debt collection agency push for court for non payment? According to the keeper there is still a small amount of outstanding finance owed on the vehicle. Does this make a difference to the debt collection agency? One thing that did stick out for the keeper was the bottom right hand corner of Doc 2 re data protection. The keeper is not happy that their information was used like this and given to the debt collection company. Any recourse there? The keeper would appreciate any help that can be given... Any advice on what the keepers next step should be? The ball is in the parking company's court unless the keeper wants to pay the charge? Does this debt collection agency push for court for non payment? They will say they will advise their client to do so at some point for sure. According to the keeper there is still a small amount of outstanding finance owed on the vehicle. Does this make a difference to the debt collection agency? Nope, irrelevant here. (They aren't going to try and seize the car) One thing that did stick out for the keeper was the bottom right hand corner of Doc 2 re data protection. The keeper is not happy that their information was used like this and given to the debt collection company. Any recourse there? No issues here and thus no recourse. ECP had 4 court hearings for the whole of 2020 - they are not particularly litigious. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

The keeper thanks you for that advice JLC
The keeper is not inclined to give away their hard earned to someone sitting at a desk. Seizing the vehicle was worrying the keeper as, under the current climate, this is their main way of earning a living. With regards to the four hearings, how did ECP get on with them? The keeper is curious.. Having read through various other threads on here, the keeper says they'll wait to see if an LBA arrives |

Do you mean it was not sent? |

With regards to the four hearings, how did ECP get on with them? The keeper is curious.. I wish I knew too... The stats I have are only the number of hearings. I hope they lost them all -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

I hope they lost them all Hopefully Going through various forums it seems like a pretty good cash cow for this lot. And to have only 35 minutes at a service station is just ridiculous. By the time you go to the toilet, get your chocolate, crisps etc, you're almost out of time... |

Perhaps a complaint to the operator with copies to DoT and your MP. As you said Jack if time, dangerous to drive when tired, government advice to rest

Going through various forums it seems like a pretty good cash cow for this lot. I'd go as far as to say that most PPC's live off sharp practice as opposed to any genuine parking problems. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

Try contacting MFG directly
Sites are owner operated but the parking contracts are usually done by MFG themselves for ECP |
