NIP Details and Circumstances
What is the name of the Constabulary? -
Date of the offence: - April 2018
Date of the NIP: - 2 days after the offence
Date you received the NIP: - 3 days after the offence
Location of offence (exact location as it appears on the NIP: important): - A623 Hernstone Lane, Peak Forest
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - First
If your are not the Registered Keeper, what is your relationship to the vehicle? -
How many current points do you have? - 0
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - Driving through a 30mph zone in a village called Peak Forest and at the end of the village, the road bends just before it goes up a hill into a 50 mph zone. There was a mobile camera just before the 50 mph zone that caught me at 60 mph

NIP Wizard Responses
These were the responses used by the Wizard to arrive at its recommendation:
Have you received a NIP? - Yes
Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes
Did the first NIP arrive within 14 days? - Yes
Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes
Were you driving? - Yes
Which country did the alleged offence take place in? - England

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Any question?

That's going to court. A short ban is quite possible, otherwise 6 points.

Fine around 1 week's earnings. Costs of £85 and surcharge of 10% of the fine (min £30).

Assuming you are pleading guilty.

Bearing in mind the speed might be worth requesting the relevant TRO(s) depending on whether the village has street lighting, to check if the signs are in the correct place.

They will normally email if you ask the council as they are public documents.

So it's definitely court and possibly a ban?
It seems to be a band C from what I've read which means 150-175% of weekly wage.

Anything over 50 (55 in some forces) is a court hearing.

Yes and yes.

I accounted for the 33% discount for guilty plea.

OK, so here's the approach from the northern direction. The limit starts some way out with warnings before the limit signs, and a flashing sign as you get nearer. Either side of the village its 50 mph like almost all Derbyshire A roads. Difficult to argue about if you were doing 60 mph, you were already over the limit before you got to the village ! I have driven around here and seen police waiting. Its a very busy road, so I am sure the locals demand that the police regularly make checks. Maybe the head of the council lives there !

It's a clear money making scheme. 60 in a 30 zone sounds terrible but if you saw where it was you'd see what I mean. I know I was going too fast anyhow but it was up hill accelerating to get into the upcoming 50 zone and the van was hidden just before the 50mph sign.

Ignoring there was no need to accelerate to get into the 50, why approaching the 50 were you doing 60? I think calling it a clear money making scheme is a bit disingenuous under those circumstances? It’s quite common for speed camera vans to be set up near limit changes so it’s worth considering when it is and isn’t worth accelerating, saving a few seconds may have cost you your licence which sounds a poor trade off to me.

These schemes don't make any money at all. In fact they cost quite a few quid.

I know my speed was excessive and I'm not trying to condone my actions. I am obviously going to be punished accordingly, which I accept.

If I do get a short term ban then that means no points, surely that's a better outcome for me rather than 6 points???

Depends. Both have to be declared to insurers and a ban will probably be loaded more than points.

Some might find a ban of several weeks rather inconvenient too. But in terms of points towards a totting ban then, yes, it could be considered better.
