That will be interesting!
It would appear they are starting with cases of failure to pay in a P&D car park, which will always sit easier with the court than some spurious contravening of terms in a free at point of service car park. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

So I take it that it's the RK who the cases are being taken against and that might not be the driver ....Be interesting to see how that goes .

Free for 2 hours then charges. From memory those charges are not £60 or £100 or anything like the penalty charge. That's a hard sell. http://www.scotcourts.gov.uk/current-busin...0000d74aa7#MISC 2 today in Dundee. One in Airdrie on Tuesday too. http://www.scotcourts.gov.uk/current-busin...0000d74aa7#SMCL |

The PPCs will probably tell the court that the RK is the driver unless he/she names someone.

The way round that would be for the judge to ask "were you the driver?" and "Who was driving?"

The way round that would be for the judge to ask "were you the driver?" and "Who was driving?" Surely that would only be possible if the accused was giving evidence ? its small claims the judge (pretty much) has a free hand -------------------- Which facts in any situation or problem are “essential” and what makes them “essential”? If the “essential” facts are said to depend on the principles involved, then the whole business, all too obviously, goes right around in a circle. In the light of one principle or set of principles, one bunch of facts will be the “essential” ones; in the light of another principle or set of principles, a different bunch of facts will be “essential.” In order to settle on the right facts you first have to pick your principles, although the whole point of finding the facts was to indicate which principles apply.

Just sat in on the Hamilton one, both parties requested dismissal. Any way I can find out which side folded? |
