Just received a notice of intended prosecution letter, was doing 82mph on a 70. Happened on the 5th july 2020. Just wanted to ask whats the likely outcome 3 points and £100 fine ?
Also after i fill out the form, whats the next step ? Do they show me photo proof or just straight to the points fine ? And im guessing there’s absolutely zero way of getting out of these ? Van was setup at the end of a large bend. So time i seen it it was too late. Crafty. |

Just got round to posting my unsigned letter yesterday and got talking to a guy in my post office. He was saying to check the date it was issued (already had posted the letter so dont know the date) as if the wind speed was over 30mph it’s illegal for them to be operating. Is this true ?

illegal for them to be operating. Almost nothing makes it illegal for them to operate (that is they commit a criminal offence), even if the results couldn't be used lawfully. Unlawful and illegal mean two VERY different things, if someone doesn't understand that difference use their advice only very advisedly! I take an alternative view, I'd just send it back in about two weeks with it still unsigned, the aim being to delay any further action while they process it. whether it helps or not is debatable.

or they will knock on your door and ask you to sign, to which you reply that you have done everything required by law and decline. Or of course you might happen to be out.

You could start by reading the previous posts, specifically the one 3 above your last one.

You could start by reading the previous posts, specifically the one 3 above your last one. Yea im just wondering what they will say when I refuse. I know these police dont like to be told no and can try and BS you into doing stuff. We did warn you that they would be likely to try to get you to sign, you just have to be firm that you have had advice that you have done all that the law requires, if they say you will be taken to court, you say you accept that, and remain polite at all times. The alternative is to be "out" if they call. -------------------- |

Talking about a interview, just wondering if they would maybe try it on and take me to a police station. |

It was just the wording of the letter. I was wondering about that but probably for different reasons. It says "...to date no response has been received within this office." I wonder if they really mean that or whether it is a standard letter which they send either when no response has been received or when a response has been received but it is (in their eyes) deficient in some way. If they have no response at all from you, that somewhat scuttles your strategy of going down the "unsigned" route. This post has been edited by NewJudge: Fri, 14 Aug 2020 - 12:43 |

They have been calling the mobile number i put of the original letter, so that must be proof they have had a response. |
