PCN code 12r residents only

Hi my first post appologise for any errors.
I was given PCN code 12r for parking in residents bays only, on the entry to the road I have parked I saw pay and display machine and sign stating residents holders or pay at the machine, I have bought the ticket and parked to find PCN on return. I was convinced the bay I have parked was shared but they are residents only.
As I have bought the ticket I have challenge the PCN online with below points
Paid and dispalayed ticket in good faith, not familiar with the area and the sign closest to the spot was partailly covered.

Got reply from council stating that contravention did occur and PCN was issued correctly.

Are there any grounds for fromal Representation. I have attached some photos.

Judging from the council's pic, you parked roughly here:

ie right beside a resident permit only sign.

All the shared bays are round the corner.

Can't see any wriggle room here.

Parked before the post sign and just looked at the sign on the other side of the road the one in the hedge and went to pay mashine round the corner...

Yes I have parked around here on the left hand side so that the sign in the hedge was opposite across the road.

All council photos attached

The sign on the council photos is further down the road on the post visible on one of the photos in front of the car I haven't noticed it instead looked across the road ans saw the one on the hedge which was partially covered and thought those were shared bays as the ONLY bit was obscured.

Anyway looking at the google street view now there is another sign residents only sign on the opposite side of the road just after the corner which i have also missed,

But the first residents only sign on the left hand side of the road driving from the entrance is further down in front of the spot where I have parked.

Signs on the opposite side of the road to your car do not apply, only signs on the same side.

There is an argument to be made that the sign here http://forums.pepipoo.com/index.php?act=at...st&id=60762 could be mistaken for the sign here https://www.google.com/maps/@51.4118221,-0....6384!8i8192 and you could reasonably be mislead by the fact that the "or Pay at machine..." bit might have been obscured by vegetation. Signs on the other side of the road are irrelevant. The council will probably reject but you have a chance at the tribunal, if you're willing to fight this all the way and risk the full penalty at adjudication.

Thanks for all advice I have parked on the opposite side of the sign obscured by vegetation, so the sign is irrelevant.

Hello fstbol,

I have some experience of CEOs and PCNs so I hope I can help.

Having looked at the supplied photos and of the google maps link, everything appears to be in place and fully compliant. The CEO photos aren’t great but the location can still be deduced so I can’t see you being successful at an appeal with an adjudicator unfortunately.
