Hi everyone, can anyone let me know what kind of case we have with this?
The other day car parked in a metered bay in Ilford Lane, London Borough of Redbridge. The first hour is supposed to be free, with only a small 15p charge generated by booking through the RingGo App and using their SMS service. So while going through the process of booking, the app failed -- but this was not realised until ten minutes later. It was assumed to be working correctly, but the bank message said that the payment was not approved in time, even though nobody delayed when approving the transaction. The car was parked at 15.20, the penalty was issued at 15.28, and the parking attendant only timed 4 minutes from his/her arrival at 15.24. (see attachment) Apart from that, the ticket says that no permit was displayed -- which wouldn't happen with an app anyway. The error with the app was only noticed after seeing the ticket -- there were sufficient funds in the bank account, but this was seemingly caused by some other issue. Thank you! Given you have proof you tried to start a free 1 hour session before the PCN you'd expect the council to cancel this regardless of what the glitch is and who is responsible as they are no worse off.
But this is Redbridge and they are much better off with your £55. But you must have a go. |

Given you have proof you tried to start a free 1 hour session before the PCN you'd expect the council to cancel this regardless of what the glitch is and who is responsible as they are no worse off. Gives us a link to the location on google streetview, and either post the council photos or give us the number plate so we can look them up.
Something is definitely wrong because it's not the right contravention for a metered bay. Maybe you got lucky and the CEO selected the wrong contravention code, but without seeing the CEO photos it's impossible to say. -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php

I've noticed that the sign does not mention the RingGo app -- but calling the number prompts you to download the app and I've parked in this location numerous times in the past -- as far as I am aware, there is no ticket machine nearby, and as such a 'valid permit' would have been impossible unless I was a resident. Edit: I've just remembered / realised that the 15p I would have paid, was merely to cover a text alert for the end of the parking session -- it's not even a proper admin fee for using the service. As has been said already, wrong code used. Should have been a 12 so the PCN must be cancelled.

Yes this is a shared use bay and the PCN should describe the possible contraventions, which code 12 does but 16 doesn't.

Would something like this be sufficient for a challenge letter? QUOTE To The London Borough of Redbridge,
I wish to challenge penalty charge reference XXXXXXXXXXXXXXXXXXX on the following grounds. 1. The PCN incorrectly states a code 16 contravention; "Parked in a permit space or zone without clearly displaying a valid permit"-- however, this is a shared use bay, no visible permit is required, and had a contravention occurred (which I deny), the correct code would be 12. 2. Nevertheless, parking in this bay is free of charge for the first hour -- which is clearly shown when you log the parking via RingGo. The car was parked at 15.20 and left at 15.30 -- the penalty charge was issued during a four minute window between 15:24 and 15:28. 3. Every effort was made to register the intention to park through the RingGo App. As you can see from the screenshot, an error caused the app to fail -- this was not spotted because the app is generally reliable, and usually works as expected. The app error went unnoticed until returning to the car and seeing the PCN at 15:30. Yours faithfully, My only worry here is that I wouldn't trust anyone reading the challenge to understand; the cynic in me questions whether they'll have the brains (or training) to know the difference between a permit zone and a shared use zone. The council is going to reject no matter what you say. The key point is that the representation is really straightforward and focuses on a single point, if they fail to consider it properly (which I think they will) then that gives you an additional ground of appeal at the tribunal.

I'm not sure if this will change anything (probably not) but I needed to park there again today, and noticed this on the same lamppost as the original photo -- it's at chest height, facing the pavement -- hence not easy to spot from Google Streetview (or even a car), but it does state that the first hour is free (when booked through the App): This post has been edited by Messy: Mon, 6 Dec 2021 - 15:07 |
