They’ve made their decision, although some of their reply is rather presumptuous as they seem to think they are a court, the advice is also wrong, nothing to stop you accepting an FP and arguing the ‘other’ allegation is statute barred as one offence. Thanks. I've done some googling (and searching on this forum) and it's not uncommon for people to be caught speeding on a the same stretch of road minutes (single digits) apart. However, what's not clear is the likelihood of achieving the result we want if we allow it to go to court? Are their clear guidelines/criteria, or past cases that have set a precedence for what is considered a 'single offence', despite being clocked twice on the same journey? Everything i've read on this topic if very vague. It’s vague because it’s a matter of fact, not law. |

Why was she banned for a year, rather than six months? My understanding (possibly incorrect) was that totting bans were a minimum of 6 months unless reduced (potentially to zero) by an exceptional hardship plea. Your understanding is correct but in practice it is unusual for the ban to be more than six months. The court should have explained why. |

The issue the court will have is why you continued to drive for an hour if you were that concerned. |

TT99 is just an endorsement code denoting a “totting ban”. She’ll simply be punished for the latest offence - probably a driving course if she’s not done one in the last 3 years, otherwise a fixed penalty. |

It will at least allow you to enter a guilty plea and get 1/3 off the fine - however, the fine might go up as it will have been based on (IIRC) £440 per week assumed earnings, so if you earn £660 per week or more it might be better to leave the fine as it is. |

Being the owner (“technically” or not) isn’t the issue. Being the registered keeper is. You would have a defence if you had ceased to be the person keeping the vehicle and had informed the DVLA but sadly you did not. |

As you were driving you hopefully know roughly what speeds you were doing and whether it was even possible to ping you at 57 or not? Evidently not. All he’s said is he didn’t know what speed they said, he’s never mentioned what speed he may have been doing. And yet answer came there none. |

Presumably one could also point to the Criminal Procedure Rules, where ‘business day’ doesn’t include a Saturday. |

On my way home today I came round a roundabout and drove towards entering a 40 and as I enter the 40 I see a police car further down with a speed gun, I heard from a friend that if they are recording speed in a 40 for example, they can’t record you coming into it whilst still in the 30 but only going out of it, what grounds would I have and is this true? Many thanks I’m not sure how what your friend said makes any logical sense. Does it? |

Indeed. cp has just confirmed to me by e mail. This is the thing: when pepipoo was down, it was concerning as many OPs may well have missed deadlines. The same applies to ftla as not all OPs post on both. Surely it will only be concerning if it lasts for a significant amount of time? |
