Quick question, my daughter failed to top up her Dart charge account and has received the £37.50 charge + penalty. She is at Uni in Essex and uses the crossing regularly, and has always had money in the account until this one off.

Is any appeal worth it or is this a slam dunk pay up?

(have searched but all the threads are old)

Presumably the account is back in the black now? Dart have been quite reasonable in the past. That said
As usual, for best advice please post up here both sides of the PCN,

Try this:
Do not attach docs/photos, but use this method:
Some are having problems with Tinypic at he moment.. try Flickr, where the BBcodes are concealed behind the curly arrow for sharing - clicking on the arrow reveals a list of BBCodes..

Photo or scan. see http://forums.pepipoo.com/index.php?showtopic=36858&st=0
for how to do it. I use Tinypic for stage 2 with no problems. Thera are other sites, such as Flickr, which enable you to paste the BBCodes into your post here.
STAGE 1 takes care of resizing. If you use Tinypic for Stage 2, on the left each image in Tinypic is a list of links. Highlight and copy the entire link 'for forums' from the list for each image - beginning with IMG and ending /IMG (include all the square brackets [ ] ), and paste each link into your post. Each copied and pasted link will embed a thumbnail link in your post.

Using the attachment method is not advised as it means quickly running out of attachment space.

Redact/obscure name, address, PCN number and reg.mark.
LEAVE IN all dates/times; precise location, Contravention code and description.

DART management have indeed been reasonable in the past, and with you having an account with a proven payment record, may be reasonable again. You could try phoning them to point out what had happened. However don't miss the appeal deadline. Don't they have an auto-top-up facility ? If they do, best to use it if your daughter is a frequent user, I reckon.

My daughter has put an appeal in based on it being a one off oversight whilst being busy at Uni, will post the response.

What exactly were you asking us then?

Most likely you are right.
But, as written, could be £35 Charge Cert surcharge + £2.50 + £70 original penalty.

Yes it was that, discount for early payment. My daughter put in an appeal making it clear that she did not dispute the charge but asking that they consider waiving the penalty as she is a regular user, a skint student and this was an oversight. Got a response today charge and penalty dropped.

Thanks for the responses, we were not disputing that the charge was valid merely trying to avoid paying the penalty.

It is very pleasant to see at least one enforcement authority acting reasonably. Let's hope they also act the same when operating the new Mersey Gateway. Already the PCN count for this new bridge is well over 50,000 !! I crossed it myself last Sunday, paying in advance so I didn't forget.
