having reviewed the circumstances of where a section 59 is issued it is clear this system stinks and is being abused causing mayhem to a lot of people .appointing the police as jury is totally ridiculous and goes against our hard fought democratic law .i am thinking of starting a petition forcing the govt to review it totally. is there any interest on here in helping this cause ?

I am thinking of starting a petition forcing the govt to review it totally. is there any interest on here in helping this cause ? Write a decent petition and I'll sign. Why not write your proposed text and post here for a review/suggestions. I see some really badly worded petitions that serve only to waste peoples time, get it right and you'll have more credibility, I recall one 'shining light' where the writer used the word 'zorsts' for exhausts....the rest of the wording was of a similar (very poor) quality of English. the biggest issue with S59 notices is that there is no formal method to challenge the issuing (or subsequently a seizure when a second incident occurs), for almost every other 'penalty' (in the plain English sense of the word) you have some form of 'arbitration' (tribunal, court etc). -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

Why would the police issue a S59 randomly?
Whenever I have heard of them wrongly issued it seems to be the police have a reasonable belief it was justified. Presumably the alternative is to prosecute but that seems more onerous on the driver than a S59. Moral of the story is if you want a car that is fun to drive get a car with a proper engine, not rag around in a 1l Corsa which will inevitably attract unwanted attention. |

police issue stuff randomly ,,perhaps u are thinking all police would never do that ,ha even just a cursory glance on here means that is not the case .ive just looked a previous petitions on this matter one of which only got 12 voted mind i dont know wether it was promoted or not well. on a side note anyone have any idea what the penalties are for section 34 driving off road

on a side note anyone have any idea what the penalties are for section 34 driving off road Are you taking the mick? not at all iheard other day that if they could not get u on a warning they might try getting u for driving off road , so was wondering about fines etc |

I think section 59 is fine. If they seize your car and you can show, on the balance of probabilities, that they shouldn't have, you have a perfectly viable claim for tortious interference with property. I think every town has a car park where chavvy tw*ts gather with chavvy tw*t cars to race up and down in the 100 metres available be irksome and chavvy tw*ts. I have never heard of anyone getting a S59 who isn't being a chavvy tw*t, although as always they have some hard done by excuse. Every normal motorist gets concerned about getting a speeding ticket, but it is practically impossible to get a S59 without being a chavvy tw*t or coincidentally having a chavvy tw*t car in the close vicinity of, but totally unconnected to, other chavvy tw*ts. |

Or Quad bikes or scramblers on local park land.
Both of which can be prevalent round here and heard a few tales of police seizing them. No idea what notice or legislation used but TBH, could as easily be no insurance or under age riders or no licence. |
