What is the name of the Constabulary? - Date of the offence: - September 2018 Date of the NIP: - 31 days after the offence Date you received the NIP: - 31 days after the offence Location of offence (exact location as it appears on the NIP: important): - A374 Shapters Road heading into Gdynia Way, Plymouth, Devon Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - Not known If your are not the Registered Keeper, what is your relationship to the vehicle? - Lease Car How many current points do you have? - 0 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - I do not remember this even happening as I cannot recall this location but I did hire this lease car and I was at Plymouth for work. Hey guys,
Thanks again for inputs but I am still not sure how and what to proceed with? Is it possible to ask for evidence of picture or video footage so as to identify the driver? I dont want to say it is me, incase it is not as I am still unsure. Something like this: Dear Devon & Cornwall Police: I am writing this letter in reference to the alleged NIP reference XXXXXXXX. Can you possibly provide me any photos or videos of the incident so as to help me identify the driver? Regards |

You should also bear in mind that if - as is quite likely - any photographs are not sufficient to identify the driver you are still obliged to do so. The evidence that the police use to identify the driver does not come from photographs. It comes from a declaration by the driver. Whilst it is an offence to deliberately name a person who you know was not driving, it is not an offence to name the person whom you believe was most likely to have been the driver (even if you are not 100% sure). If you miss the 28 day deadline the police may, soon after, begin to consider a charge of "failing to provide driver's details". Once they do that things get messy - and possibly expensive.
