QUOTE but 56 days (the maximum ban) This assertion was posted in another thread (it doesn't matter by whom). I've seen it quite a bit, even from qualified posters. However, I can find no statutory cap on the length of a ban for a single offence - where's the legal backing for this assertion? -------------------- Moderator

There is none afaik.
The mags are free to ban for 1 year or more if they felt like it. I have heard of 20 year to life driving bans. |

As the person who made the remark, to clarify my meaning was the maximum ban within the guideline range.
I suppose I could have made that more explicit, but within the thread in question it didn't seem all that germane to distinguish between the two since we were talking after the sentence was passed. For what it's worth, I wouldn't pretend to know whether there is an actual limit to the length of ban they can hand out, though I'm aware they can hand out more than the guidelines suggest. I'd also suppose there's also no law to stop them banning someone for just one day (less than the guidelines suggest), though I don't know that either. Whether other posters believe the 56-day (guideline) maximum is a statutory maximum I couldn't say. |

This link may help explain the significance of 56days. Indeed - more than 56 days creates an admin burden of applying for the licence. As the person who made the remark, to clarify my meaning was the maximum ban within the guideline range. CO, I only "picked" on you as yours was the comment I read at the time. -------------------- Moderator
